This Office Memorandum addresses the consideration of compassionate appointments for the dependents of deceased canteen employees. It clarifies that since employees of non-statutory departmental canteens/tiffin rooms are considered Government employees with full benefits, their eligible dependents should be considered for compassionate appointments. However, due to a ban on filling posts within canteens, such appointments may be made in other work areas of the respective departments, excluding the canteen itself. Requests for compassionate appointments should not be rejected solely because the deceased was a canteen employee or due to a lack of vacancies within the canteen. Ministries and Departments are urged to ensure the implementation of these instructions and to disseminate this information to all subordinate and attached offices.

OFFICE MEMORANDUM

Subject : Compassionate appointments to the dependents of deceased canteen employees- matter regarding.

The undersigned is directed to say that canteen staff representative have brought out that Ministries/Departments are not considering requests for compassionate appointments to the eligible dependents of the deceased canteen employees.

  1. The employees of non-statutory departmental canteens/ tiffin rooms located in Central Government Offices have been declared as Government employees w.e.f. 1.10.92 vide this Department’s O.M. No.12/5/91-Dir.(C) dated 29.1.91 and have been extended all benefits as are available to other Government employees of comparable status. As such the eligible dependents of the deceased canteen employees are to considered for compassionate appointment as per orders/instructions on the subject. However keeping in view the complete ban on creation/ filling up of posts in the canteens imposed vide O.M. No. 3/1/92-Dir.(C) dated 30.1.92, such appointments may be considered in other work areas of the respective departments except in the canteen. Requests received from kin of deceased canteen employees for appointment on compassionate grounds should not be rejected merely on the ground that deceased employee was a canteen employee and/or vacancies in the canteen are not allowed to be filled up.
  2. All the Ministries/ Departments are requested to ensure implementation of these instructions and also bring these to the notice of all Subordinate/Attached offices under them.
