This Office Memorandum, dated January 6th, 2016, from the Ministry of Personnel, Public Grievances & Pensions, addresses the recovery of Non-functional Selection Grade (NFSG) for officials in Central Civil Services (CSCS). Following an Order from the Central Administrative Tribunal (CAT) on December 23rd, 2015, regarding an objection raised by 34 officials, all cadre units are instructed to put recovery orders issued after the CAT order in abeyance. The memo also directs maintaining the status quo for cases where revised NFSG orders were issued before December 23rd, 2015, but recovery hadn’t begun. The directive is to await further instructions from the CAT or the Department of Personnel & Training.

OFFICE MEMORANDUM
Subject: Non-functional Selection Grade (NFSG) in the grade of UDCs of CSCS-reg.
The undersigned is directed to refer to this Department’s O.M. No. 12/2/2015-CS.II(B) dated 16th November, 2015 vide which recovery order of NFSG of 211 officials were issued. Subsequently, Ms. Sugam Arora and 33 other officials of different cadre units have filed an O.A. No. 4700/2015 before Hon’ble CAT, PB, New Delhi regarding the change in seniority positions and the recovery of NFSG. The Hon’ble CAT vide order dated 23.12.2015 has passed the following order:-
“Issue notice to the respondents on admission and IR. Shri Gyanendra Singh, Id. Sr. Central Govt. Standing Counsel accepts notice on behalf of the respondents and seeks an opportunity to file reply within two weeks. Allowed. List on 06.01.2016. In the meantime, status quo regarding position of the applicant as on date would be maintained. A copy of this order be given Dasti to the learned counsel for the parties”

- The concerned cadre units are, therefore, requested to keep the recovery orders passed by them after the date of order passed by Hon’ble CAT i.e. 23.12.2015 in abeyance and not to issue any further order for recovery of NFSG of the above mentioned 34 officials till any further directions from Hon’ble CAT or from this Department. Even in cases where revised NFSG order has been issued by the cadre units on or before 23.12.2015 but recovery process has not yet been initiated, status quo may be maintained till further orders from Hon’ble CAT or from this Department.
