This is regarding relieving of officers of the three Central Services i.e., CSS, CSSS & CSCS who on promotion are nominated from a central panel to various cadres by the CS Division of this Department on the basis of vacancies reported by them.
- Promotions/nominations are made on the basis of a Select List in a grade for a particular recruitment year, prepared in accordance with the prescribed recruitment rules. The cadres report vacancies accordingly to this Department for filling up through different modes of recruitment viz., Direct Recruitment (DR), Seniority Quota (SQ) and Limited Department Competitive Examination (LDCE) in the ratio prescribed. These vacancies are filled up through the UPSC or SSC in case of Direct Recruitment and in case of Seniority Quota, this Department fixes the range of seniority under the ‘zoning scheme’ for promotion to a grade of a service based on vacancies reported by all cadres. According to the existing instructions, the officials nominated to other cadres from the central panel against the vacancy of a particular Select List Year are to be relieved of their duties within 45 days to join the new cadre(s), failing which they are to be debarred for regular promotion for subsequent three Select List Years.

Of late, it has been observed that such officials who are included in a particular Select List Year and nominated to other cadres are not being relieved of their duties by the cadre(s) concerned on one ground or the other. It has also been observed that the requests for retention of such officials for regular appointment in their own cadre are being made by the cadre(s) on the ground that vacancies have since become available or are available in the subsequent Select List Year to adjust them.

Such requests are not tenable as they are not in accordance with the provisions of the relevant recruitment rules. Officials nominated against the vacancies of a particular Select List Year cannot be adjusted against the vacancies occurring in the subsequent Select List Year and hence cannot be accepted/agreed to. Cadres are making requests for retention, which not only result in delaying regular promotions of individuals concerned, but also leads to wastage of time and resources. Therefore, I would request you please to instruct the officers dealing with Establishment matters in your Ministry/Department to avoid making requests that are not in consonance with the Government instructions/Statutory Rules and ensure the prompt implementation of promotion transfer orders in respect of CSS/CSSS and CSCS personnel, issued by this Department.
- I shall be grateful if you could kindly issue necessary directions to the concerned officers of your Ministry in this regard.
