Non-Relieving of Under Secretary of CSS – Reminder

This office memorandum addresses the delayed relieving of Under Secretaries covered under a rotational transfer order issued on January 18, 2013. Despite reminders, several officers haven’t been relieved by their respective Ministries/Departments, exceeding the stipulated 75-day period. The Department of Personnel & Training (DoPT) emphasizes its role as the cadre controlling authority for CSS Officers and highlights that delayed relieving negatively impacts cadre management. It reminds Ministries/Departments of Rule 19 of the CSS Rules, 2009, which stipulates that officers not relieved within 45 days are deemed relieved and ineligible for further pay and allowances. Ministries/Departments are urged to immediately relieve the officers without further delay. A list of relevant Ministries/Departments and their respective Joint Secretaries (Admn.) is also provided for direct communication.

OFFICE MEMORANDUM

Subject: Non-relieving of Under Secretary of CSS covered under RTP order dated 18.01.2013- regarding.

The undersigned is to refer to this Department’s OM of even No. dated 18.01.2013 and subsequent reminders dated 26.02.2013 and 14.03.2013 on the subject mentioned above and to say that a few officers covered under rotational transfer order dated 18.1.2013 have not yet been relieved by the Ministries/ Departments concerned despite lapse of more than 75 days from date of issue of the order.
2. This Department is the cadre controlling authority of CSS Officers and non-relieving of officers within the stipulated period is adversely impacting cadre management of CSS. Attention of Ministries/ Departments and individual officers is also invited to Rule 19 of CSS Rules, 2009 (Notification dated 15.09.2010), that if an officer is not relieved within forty-five days of order issued by this Department, the officer concerned shall be deemed to have been relieved and the officer concerned shall also not be entitled to draw pay and allowances from the current Ministry /Department beyond this stipulated period.
3. Since the stipulated 45 days has already expired on $3^{\text {rd }}$ March 2013, Ministries/Departments are requested to relieve officers immediately without any further delay.
