Non-Relieving of Under Secretary of CSS – Rotational Transfer Order

This office memorandum addresses the delayed relieving of Under Secretaries covered under a rotational transfer order issued on January 18, 2013. The Department of Personnel & Training notes that several officers have not been relieved by their respective Ministries/Departments even after a significant delay of over 120 days. The memorandum reiterates that failure to relieve officers within 45 days results in them being deemed relieved and ineligible for further pay and allowances from the current Ministry/Department. Ministries/Departments are urged to expedite the relieving process to avoid negatively impacting cadre management. A list of relevant Ministries/Departments and their Joint Secretaries (Admn.) is also provided.

OFFICE MEMORANDUM

Subject: Non-relieving of Under Secretary of CSS covered under RTP order dated 18.01.2013- regarding.

The undersigned is to refer to this Department’s OM of even No. dated 18.01.2013 and subsequent reminders dated 26.02.2013, 14.03.2013 04.04.2013 and 01.05.2013 on the subject mentioned above and to say that a few officers covered under rotational transfer order dated 18.1.2013 have not yet been relieved by the Ministries/ Departments concerned despite a lapse of more than 120 days from the date of issue of the order.
2. Non-relieving of officers in compliance of order issued by this Department is adversely impacting cadre management of CSS. It is reiterated that in terms of Rule 19 of CSS Rules, 2009 (Notification dated 15.09.2010), if an officer is not relieved within forty-five days of order issued by this Department, the officer concerned shall be deemed to have been relieved and the officer concerned shall also not be entitled to draw pay and allowances from the current Ministry /Department beyond this stipulated period.
3. Ministries/Departments are, therefore, once again requested to relieve officers immediately without any further delay.
