ORDER

Approval of the competent authority is hereby accorded to the appointment by promotion on ad hoc basis of the under mentioned officers of the Grade-I (Under Secretary) of the Central Secretariat Service as Deputy Secretary in Pay Band 3 (Rs 15,600-39,100) with grade pay of Rs 7600 – initially for a period of one year with effect from the date of assumption of charge, or until further orders, whichever is earlier:-

  1. The aforesaid ad-hoc promotions of the officers is subject to the following conditions:-

(i) The ad-hoc promotions are subject to the final outcome of the pending Writ Petition No. 4097/2011 (Arun Gaur Vs Garima Singh & Ors), W.P. No. 4616/2011 (V.S.Pandey & Ors Vs. Garima Singh & Ors), W.P. No. 7619/2011 (UPSC Vs Garima Singh & Ors), W.P. No. 2176/2012 (Union of India Vs. Garima Singh & Ors) and other connected Writ Petitions Nos. W.P.(C) 2523/2012 (Union of India Vs. Anant Kishore Saran), W.P.(C) 2524/2012 (Union of India Vs. Shersha and Anr), W.P.(C) 2525/2012 (Union of India Vs. Syed Eram Rizvi and Anr), W.P.(C), W.P.(C) 2526/2012 (Union of India Vs. Sandeep Kumar Gupta), and W.P.(C) 2527/2012 (Union of India Vs. Soumya Chattopadhyay and Anr) in the High Court of Delhi and also any other order by any competent court in any of the connected matters, apart from the above.

(ii) The ad-hoc promotions shall not confer any right on the officers to continue in the grade of Deputy Secretary indefinitely or for inclusion in the Select List for regular promotion to the grade or to claim seniority in the grade.(iii) The ad-hoc promotions shall be initially for a period of one year or until further orders, whichever is earlier.
(iv) The ad-hoc promotions may be terminated at any point of time without giving any reason therefor.
(v) The ad-hoc promotions will take effect from the date of assumption of charge of the post of Deputy Secretary in the Ministry/Department to which the officers are allocated.
(vi) The ad-hoc promotions are further subject to vigilance clearance in terms of DOP\&T O.M. No. 22011/4/91-Estt.(A) dated 14.9.92, O.M. No. 22012/1/99-Estt.(D) dated 25.10.2004 and O.M. No.22034/4/2012-Estt(D) dated 2.11.2012 and also other relevant instructions. In the case of the officers serving in the cadre, the Ministry/Department where the officers are posted should notify the promotion of the officers only after verifying that no disciplinary proceedings are pending or contemplated against them. In case of pendency of such proceedings, the matter may be reported to DOP\&T (AVD \& CS-I Division) immediately before taking any action with regard to promotion of the officer concerned.
(vii) If an officer including an officer on deputation fails to assume charge of the post of Deputy Secretary in the Ministry/Department to which he/she has been posted on promotion, within 30 days of issue of the order by DOP\&T without the prior approval of the Cadre Controlling Authority for extension in joining time, his/her ad-hoc promotion will automatically stand cancelled.
4. The posting order earlier issued in respect of Shri G.C.Yadav vide order No.4/3/2013-CS-I(D) dated 3.2.2014 to Ministry of Minority Affairs stands cancelled.
5. A copy of the notification implementing the order may be endorsed to this Department.
