OFFICE MEMORANDUM
Subject: Select Lists for the years 1984, 1985, 1986, 1987 and 1988 of officers of the Central Secretariat Service for appointment to Grade I (Under Secretary grade) of the CSS.
It may be recalled that the Central Administrative Tribunal had in effect quashed the CSS Grade. I panels prepared for the years 1984, 1985, and 1986 by its judgement dated the 31st August, 1988 in OA No.1659/87 etc., filed by Shri Amrit Lal & others. Thereafter, there were protracted litigations between direct recruit and promotee Section Officers of the CSS for a period of about 10 years regarding inter se seniority. Finally, the Hon’ble Supreme Court by its judgement dated 9.5.97 directed the Central Government that the final Common Seniority List dated 15.5.96 may be redone in accordance with the law declared by it. In compliance with the aforesaid orders of the Hon’ble Supreme Court a fresh CSL of Section Officers was prepared and issued on 3.12.97.
- Based on the revised seniority positions held by the CSS officers in the CSL dated 3.12.97, the panels for 1984, 1985 and 1986 have been reviewed by the DPC keeping in view the assurance given by Government in the affidavit dated 5.9.90 filed in the Hon’ble Supreme Court (in pursuance of the suggestions of the Hon’ble Supreme Court). Through the affidavit an undertaking was given by this Department to the effect that seniority already assigned to the 21 direct recruit Section Officers of 1977 batch included in the 1984 panel would remain intact. These officers had been rendered ineligible for inclusion in the 1984 panel consequent upon giving retrospective effect to the amendment to the CSS Rules notified in December 1984 with effect from 1.7.84 instead of 1.7.85 in compliance with the Supreme Court’s order as they did not possess 8 years approved service in the grade of Section Officers as on 1.7.84 as required under the amendment. However, as per the affidavit the aforesaid Direct Recruit Section Officers would have to be protected in regard to their position in the Select List of Grade I of CSS (Under Secretary Grade). of promotee Section Officers, 21 supernumerary posts of Under Secretaries were created for the 1984 Select List to consider the cases of promotee Section Officers, who figured in the zone of consideration for that list. The duly constituted DPC met in the office of the UPSC from 27th to 30th March, 2000 and considered the proposals for the requisite limited review of the panels of Grade-I of CSS for the years 1984, 1985 and 1986 and for the fresh panels for 1987 and 1988. Lists of officers prepared under Rules 12(4) of CSS Rules, 1962 and the Central Secretariat Service (Promotion to Grade-I and Selection Grade) Regulations, 1964 for appointment to Grade-I of the Central Secretariat Service under Rule 12(2) of the Central Secretariat Service Rules, 1962 are given in the Annexures ‘A’ (Additions to Select List 1984), ‘B’ (Select List 1987) and ‘C’ (Select List 1988) to this Office Memorandum. In conformity with the position stated in the aforesaid affidavit, the Select Lists for the years 1985 and 1986 already issued in December, 1985 and December 1986 respectively by this Department do not require any change as there was no variation in the vacancies etc. for these years and these Select Lists may now be treated as final. (It has been confirmed by the DPC in their recommendations also).
- Actual appointment to Grade. I of CSS will, however, be subject to the approval of the Central Establishment Board. The order of seniority of these officers in Grade I of the Central Secretariat Service will follow the serial order given in the enclosed lists, irrespective of actual dates of appointment to Grade. I
