OFFICE MEMORANDUM

Subject: Select Lists for the years 2001 and 2002 of officers of the Central Secretariat Service (CSS) for appointment to Grade-I (Under Secretary).

The undersigned is directed to forward herewith two Select Lists for the years 2001 & 2002 on the subject mentioned above, prepared under rule 12(2) of the Central Secretariat Rules 1962 and the Central Secretariat Service (Promotion to Grade I and Selection Grade) Regulations, 1964 for appointment to the Grade I of the CSS, as given in the Annexure-1 (Select List for the year 2001) and Annexure-2 (Select List for the year 2002).

  1. The Seniority of the officers included in the aforesaid Select Lists, will be in the same order in which their names have been arranged, irrespective of actual dates of their appointment to the Grade I. The appointment of officers included in the aforesaid Select Lists, to the grade of Under Secretary, on regular basis, shall be subject to the final outcome in the Civil Writ Petition No. 3269/2003, CWP No. 3912/2003 and CWP No. 13352/2005 in the High Court of Delhi.

  2. The vacancies against which officers have been included in the Select Lists relate to the period from 1st July of the respective Select List year to 30th June of the following year. The regular Select List could not be drawn within the prescribed period for such panel due to protracted litigation and these panels have been gone in arrears. The appointment of the officers included in the aforesaid Select List may be deemed to have been made effective with effect from 1.7.2001 & 1.7.2002 respectively for the purpose of approved service as well as for fixation of their pay as Under Secretary on a notional basis. The actual benefits however, would be available only from the date the officers are so appointed to the post of Under Secretary.

  3. The officers would be entitled to arrears on account of re-fixation of their pay from the dates of their actual appointments to the post of Under Secretary. In addition, these officers shall also be entitled to exercise the benefit of option for fixation of their pay as provided in Provisions of FR 22.

However, such officers, who were promoted as ad-hoc Under Secretary prior to 1st July of their Select List year and had availed the benefit of split option, shall not be eligible to re-exercise the option.

  1. All Ministries/Departments are requested to notify the appointment of the aforesaid officers to the Grade of Under Secretary on regular basis subject to condition that the officer concerned is free from vigilance angle.

  2. The officers, who were in service on crucial dates but had retired as Section Officer/Desk Officer subsequently on superannuation or otherwise, have also been considered for inclusion of their names in the aforesaid Select Lists of Grade I of CSS in pursuance of this Department’s OM No. 22011/4/98-Estt(D) dated 12th October, 1998. However, their appointment need not be notified as promotions may take place prospectively and retired persons may not be available to avail the actual promotion from a prospective date.
