Decision on the Allocation of Class-IV Employee Shri Som Prakash from Erstwhile Uttar Pradesh

D

Recently, a significant decision was made regarding the allocation of Class-IV employees from the erstwhile State of Uttar Pradesh, particularly focusing on the case of Shri Som Prakash. A dedicated committee thoroughly reviewed his representation, concluding that as a district cadre employee, his request for allocation based on option was not in line with existing guidelines. These guidelines clearly state that only Class-IV employees belonging to the State Cadre are eligible for such transfers at their discretion. Following the committee’s recommendation to reject the representation, the Government of India has affirmed that Shri Som Prakash’s allocation will remain within the successor states of Uttarakhand. This decision underscores the importance of cadre classification in personnel transfers.

Subject: Decision on the representations of Class-IV employees of erstwhile State of Uttar Pradesh regarding

Sir,

I am directed to say that the representation of Shri Som Prakash Class-IV employees in the Office of Chief Agriculture Officer, Haridwar was considered by the Committee headed by Dr. S.K. Sarker, Joint Secretary in its meeting held on 24.8.2009. The Agriculture Department Uttar Pradesh vide letter No. HQ(11)Class-IV/Panch/1690 dated 21.8.2009 informed the Committee that Shri Som Prakash is a district Cadre employee. As per the Communication No.14(C)/03/2006-SRS dated 2.11.2007, only the Class-IV employees belonging to the State Cadre are to be sent as per their option. The Committee, therefore, recommended to reject his representation being a district cadre employee, who are transferable within the same district.

The Government of India has accepted the recommendations of the Committee and accordingly the allocation of Shri Som Prakash continues to be in the successor States of Uttarakhand. Officer concerned may kindly be apprised of the position.

Yours faithfully,

(S. Nayak)
Under Secretary to the Govt. of India
