The Government of India has affirmed an administrative decision concerning the personnel allocation of Shri Muneshwar Prasad, a pharmacist serving in the Medical and Health Department. This decision comes after a directive from the Allahabad High Court prompted a review of Shri Prasad’s request for a revision of his posting. An Advisory Committee, tasked with considering the representation, meticulously examined the grounds presented by Shri Prasad. His appeal was based on several personal circumstances, including his status as the juniormost backward class individual, the necessity to care for his elderly mother, his children’s education in Bahraich (Uttar Pradesh), the lack of an option for allocation to Uttarakhand, and his domicile in Bahraich. However, after careful deliberation, the Committee concluded that these factors did not fall within the scope of the existing reorganization guidelines. Consequently, they recommended rejecting his plea for reallocation from Uttarakhand to Uttar Pradesh. This recommendation has been accepted by the central government, solidifying that Shri Prasad’s allocation remains unchanged. All pertinent authorities and the concerned official will be duly informed of this final determination.

Sub.: Compliance of directions dated 08-07-2010 of the Allahabad High Court, Lucknow Bench in Writ Petition No.4521/2010 – Decision in the representation of Shri Muneshwar Prasad, Pharmacist, Medical and Health Department – regarding.
Sir,
I am directed to refer to the order dated 08-07-2010 of the Hon’ble Allahabad High Court, Lucknow Bench vide which the Hon’ble Court has directed the Government of India / State Advisory Committee to consider the representation of Shri Muneshwar Prasad and to say that the representation dated Nil of Shri Muneshwar Prasad was considered by the Advisory Committee headed by Joint Secretary (SR) in its meeting held on 1-12-2010. In the representation, the petitioner has mentioned the following grounds in support of seeking revision of his allocation:-
i) He is juniormost backward class person
ii) No other person to look after old mother
iii) Children studying in Bahraich, UP
iv) No option given for allocation to Uttarakhand
v) Domicile of Bahraich, UP
- Since the grounds mentioned by Shri Muneshwar Prasad, as brought out above, are not covered under the guidelines on Reorganisation, the Committee recommended to reject his representation for revision of allocation from Uttarakhand to Uttar Pradesh.

The Government of India has accepted the recommendations of the Committee and accordingly allocation of Shri Muneshwar Prasad remains unchanged and continues
