Decision on Shri V.K. Sundaram’s Representation for Allocation Revision

A recent decision by the Government of India has addressed a long-standing personnel allocation matter involving a Constable (T) from the Home Department. This case originated from a High Court judgment that directed the individual to submit a representation regarding their allocation. The employee sought a revision of their allocation from Uttarakhand back to Uttar Pradesh, citing personal reasons such as family residing in Lucknow, children studying in UP, and the need to care for a widow mother. These reasons were presented in compliance with the court’s directives.

An Advisory Committee was formed to consider the representation, carefully reviewing the grounds put forth. After due deliberation, the committee determined that the individual’s initial allocation to Uttarakhand was based on their own option. Consequently, the committee recommended rejecting the request for a change in allocation. The Government of India, upon reviewing the committee’s findings, accepted these recommendations. As a result, the Constable (T) will continue to be allocated to the successor State of Uttarakhand, and the concerned authorities have been instructed to inform the individual of this final decision.

Sub : Consideration of representation of Shri V.K. Sundaram, Constable (T), Home Department, in compliance of the directions dated 29/02/2008 of Hon’ble High Court of Allahabad, Lucknow Bench, Writ Petition No. 1126/2008 – regarding Sir,

I am directed to refer to the subject noted above and to say that Hon’ble High Court of Allahabad, Lucknow Bench vide judgement dated 29.02.2008 in Writ Petition No. 1126/2008 granted same consideration as provided vide order dated 12.12.2007 directing that “The petitioners to make representations expeditiously within a period of fifteen days from today through proper channel. In case the department concerned forwards the representations of petitioners and all those employees who submit their representations keeping in view the order dated 12.12.2007 the respective committee may adjudicate the controversy expeditiously and preferably within a period of one month. Subject to the aforesaid directions the writ petitions are disposed off with no order as to costs.”
2. Shri V.K. Sundram in his representation dated 01.03 .2008 , has raised the following grounds:
(i) Family residing in Lucknow
(ii) Children studying in UP
(iii) Taking care of widow mother
3. The representation of Shri V.K. Sundram, received in compliance of the directions dated 29.02.2008 of Hon’ble High Court of Allahabad, Lucknow Bench in Writ Petition No.1126(S/B)/2008 on the above grounds, was considered by the Advisory Committee in its meeting held on 14.02.2011. The Committee found that Shri Sundram was allocated to Uttarakhand on option basis and as such recommended for rejection of his representation for revision of allocation to Uttar Pradesh, since he was allocated as per his own volition.4. The Government of India has considered the representation as well as the recommendation of the Committee and decided to accept the recommendations. Accordingly, Shri V.K. Sundaram, Constable (T), Home Department continues to be allocated to the successor State of Uttarakhand. The official concerned may kindly be apprised about the decision.
