Final Allocation of PCS Officers Shri Harbans Singh and Shri Ashok Kumar to Uttarakhand

A protracted administrative process concerning the allocation of two Provincial Civil Service (PCS) officers, Shri Harbans Singh and Shri Ashok Kumar, to the state of Uttarakhand has reached a resolution. While initially recommended for transfer to Uttarakhand based on domicile in 2002, their final allocation was put on hold after they secured stay orders from the Hon’ble Allahabad High Court. With the subsequent dismissal of their writ petitions in 2002 and 2011, the legal barriers to their transfer were removed. Following their renewed representations, an Advisory Committee re-examined the matter in June 2011 and concluded that there were no longer any legal impediments to their allocation. The Government of India has now accepted these recommendations, officially allocating both officers to the successor State of Uttarakhand, exercising powers conferred under Section 73 (2) of the U.P. Reorganization Act, 2000. This allocation is effective from November 9, 2000, which marked the appointed day for the state’s formation.

Sir,
Allocation of PCS officers was considered by the State Advisory Committee in its meeting held on 04-12-2002 in which, besides others, S/Shri Harbans Singh and Ashok Kumar were recommended for allocation to Uttarakhand on domicile basis by the Committee. Their final allocation could not be issued because they had obtained stay orders against their allocation from the Hon’ble Allahabad High Court.
2. These two PCS officers have submitted representations requesting for their final allocations to Uttarakhand on the ground that Writ Petitions filed by them have been dismissed by the Hon’ble Court, as withdrawn under their orders dated 28-10-2002 and 05-05-2011 respectively. The matter of their allocation was, therefore, considered in the meeting of the Advisory Committee held on 15-06-2011. The Committee recommended for issue of their final allocation orders as there is no legal impediment for doing so.
3. The Government of India has accepted the recommendations of the Committee and accordingly, in exercise of powers conferred under Section 73 (2) of the U.P. Reorganization Act, 2000, hereby allocates Shri Harbans Singh and Shri Ashok Kumar, both PCS officers, to the successor State of Uttarakhand with effect from 09-11-2000, i.e. the appointed day.
4. The officers may be apprised of the allocation.
