A recent government decision has reaffirmed the allocation of a government employee, Shri Gajendra Nath Pandey, to the State of Uttarakhand, following a detailed review process. This review was initially prompted by a directive from the Allahabad High Court. While Mr. Pandey had previously been assigned to Uttarakhand based on a juniority criterion, he later filed a fresh representation appealing this decision. His appeal cited concerns such as limited promotion prospects within Uttarakhand, his impending retirement, and personal circumstances including not being a domicile of the state and lacking property there. However, a high-level committee carefully examined these new grounds but ultimately found them inconsistent with the established Guidelines on Reorganization. Consequently, the committee recommended rejecting his representation, a recommendation that the Government of India has now officially accepted, ensuring that his allocation to Uttarakhand remains unchanged.

Subject: Consideration of representation of Shri Gajendra Nath Pandey, Irrigation Department in terms of directions dated 12-08-2010 of Allahabad High Court, Lucknow Bench in W.P. No.822/2006 by the Advisory Committee in its meeting held on 15-06-2011.
Sir,
I am directed to refer to the subject noted above and to say that in W.P. No.839/2006, the Hon’ble Allahabad High Court, Lucknow Bench in their order dated 12-08-2010 has directed “Respondents to take a decision in accordance with law if not already taken and communicate the decision so taken expeditiously preferably within a period of two months from the date certified copy of the order is produced and communicate the same.”
2. During the meeting, the Committee found that the name of Shri Gajendra Nath Pandey was included in the TFAL for allocation under juniority category. While considering his allocation in its meeting dated 09-12-2005, the State Advisory Committee has already considered the grounds mentioned by him in his representation and recommended for his allocation to Uttarakhand. He was, therefore, ailocated to the State of Uttarakhand.
3. In his fresh representation, he has given the following grounds:-
i) There is a lack of opportunities for promotion in the State of Uttarakhand;
ii) He is retiring on 30-06-2014;
iii) Not domicile of the State;
iv) Don’t have any property in the State
4. The Committee considered the representation of Shri Gajendra Nath Pandey and since he has already been allocated on juniority basis and that the fresh grounds are also not covered on the Guidelines on Reorganization, it recommended for rejection of his representation.
- The Government of India has accepted the recommendations of the Committee and accordingly, the allocation of Shri Gajendra Nath Pandey to Uttarakhand shall remain unchanged.
- Officer concerned may kindly be apprised of the decision.
