Government Decision on Allocation of Head Constable Baijnath Sachan Following High Court Order

A recent decision by the Government of India has affirmed the allocation of Head Constable Baijnath Sachan to Uttarakhand. This ruling comes after a High Court directive from 2007, which prompted a review of his request for re-allocation to Uttar Pradesh. Shri Sachan had sought the change based on his Uttar Pradesh domicile and a reported psychiatric condition. However, a committee tasked with reviewing such cases found that his medical condition did not meet the established guidelines for revising an allocation. Consequently, the Government of India accepted the committee’s recommendation, ensuring that Shri Sachan’s original allocation to the successor State of Uttarakhand remains unchanged.

Subject : Consideration of representation of Shri Baijnath Sachan, Head Constable, PMT, in compliance of the directions dated 12.12.2007 of Hon’ble High Court of Allahabad, Lucknow Bench, Writ Petition No. 1102/2008 – regarding
Sir,
I am directed to refer to the subject noted above and to say that Hon’ble High Court of Allahabad, Lucknow Bench in their judgement dated 12.12.2007 in Writ Petition No. 1102/2008 has directed that “The petitioners to make representations expeditiously within a period of fifteen days from today through proper channel. In case the department concerned forwards the representations of petitioners and all those employees who submit their representations keeping in view the order dated 12.12.2007 the respective committee may adjudicate the controversy expeditiously and preferably within a period of one month. Subject to the aforesaid directions the writ petitions are disposed off with no order as to costs.”
2. Shri Baijnath Sachan in his representation raised the following grounds:
(i) Domicile of U.P.
(ii) Psychiatric pioL!em
3. The Committee found that Shri Baijnath Sachan was originally allocated to Uttarakhand. The Committee recommended to reject his representation as the disease mentioned in his Medical Report is not covered under the guidelines for revision of allocation to Uttar Pradesh.
4. The Government of India has accepted the recommendations of the Committee and accordingly, Shri Baijnath Sachan, Head Constable, PMT Department continues to be allocated tothe successor State of Uttarakhand. The official concerned may kindly be apprised accordingly.
