However, a subsequent review by an advisory committee revealed that the officials in question had not submitted the necessary representations. This omission was attributed by the officials to a lack of awareness regarding the original court orders or non-receipt of crucial documentation. Based on this finding, the committee recommended against any revision of their current allocations. The central government has since accepted these recommendations, confirming that the initial allocation of these officers to the successor State of Uttarakhand will remain unchanged. Sir,
I am directed to refer to the subject noted above and to say that Hon’ble High Court of Allahabad, Lucknow Bench vide order dated 12.12.2007 directed that:
“Keeping in view the circular dated 12.11.2007, the instant appeal is disposed of directing the Committee concerned to decide the appellant’s representations in accordance with law by passing a speaking and reasoned order expeditiously and preferably within a period of three weeks from the date of receipt of a certified copy of this order and communicate the decision to the appellant within next one month and during this period the appellant shall be allowed to discharge his duties in the state of U.P. on the post on which he has been promoted and will be paid his salary”.
- Accordingly the following cases were considered by the Advisory Committee in the meeting held on 15.06.2011 and the Committee recommended for rejection of their requests for revision or allocation on the ground that the petitioners have themselves admitted that they have not submitted representations in pursuance of directions of the Hon’ble Court:
