A significant decision has been reached concerning the long-standing case of Shri Kailash Chandra Joshi, an Assistant Binder. Following a directive from the Allahabad High Court, a consultative committee reviewed his representation. The High Court had initially mandated a speedy resolution, instructing the committee to decide his case and allow him to continue his duties in Uttar Pradesh on his promoted post while awaiting the outcome. However, during the review, it came to light that Mr. Joshi had repeatedly failed to comply with an administrative directive to appear before the State Medical Council, despite continuing his regular work. This deliberate non-compliance led the committee to recommend the rejection of his representation. The Government of India has concurred with this recommendation. As a result, Mr. Joshi has been permanently allocated to the state of Uttarakhand. This final decision aims to bring closure to the matter, and all relevant parties are to be notified of his new allocation.

विषय: मुद्रण एवं लेखन सामग्री विभाग के कार्मिक श्री कैलाश चंद्र जोशी, आसिस्ट्रेट बाइंडर से संबन्धित माननीय इलाहाबाद उच्च न्यायालय, लखनऊ खंडपीठ के दिनांक 12-12-2007 का पारित आदेश, जो रिट याचिका संख्या 58/2006 – शेर सिंह बनाम भारत सरकार एवं अन्य से लिंक किया गया है – का निपटान।
महोदय,
मुझे उपर्युक्त विषय में यह कहने का निदेश हुआ है की माननीय इलाहाबाद उच्च न्यायालय, लखनऊ खंडपीठ ने अपने दिनांक 12-12-2007 के आदेश में निम्नलिखित आदेश पारित किया था :-
“Keeping in view the circular dated 12-11-2007, the instant appeal is disposed of directing the Committee concerned to decided the appellant’s representation in accordance with law by passing a speaking and reasoned order expeditiously and preferably within a period of 3 weeks from the date of receipt of a certified copy of this order and communicate the decision to the appellant within next one month and during this period the appellant shall be allowed to discharge his duties in the State of U.P. on the posts on which he has been promoted and will be paid his salary.”
- अतः श्री कैलाश चंद्र जोशी, आसिस्ट्रेट बाइंडर के प्रत्यावेदन पर दिनांक 17-10-2011 को आयोजित बैठक में परामर्शी समिति द्वारा विचार किया गया। समिति को बताया गया कि श्री कैलाश चंद्र जोशी को प्रशासकीय विभाग द्वारा दिनांक 20 जून 2011 को राज्य चिकित्सा परिषद के सम्नुख उपस्थित होने का निर्देश दिया गया था। परंतु उनके द्वारा आदेशों का अनुपालन नहीं किया जा रहा है जबकि इनके द्वारा नियमित रूप अपनी ड्यूटी की जा रही है। यह देखते हुए कि श्री जोशी द्वारा जनवृझ कर राज्य चिकित्सा परिषद के समक्ष उपस्थित होने से बचा जा रहा है, समिति द्वारा उनके प्रत्यावेदन अस्वीकार किए जाने की संस्तुति की गई।
- भारत सरकार समिति की संस्तुति से सहमत है तथा तदनुसार श्री कैलाश चंद्र जोशी, आसिस्टेंट बाइंडर का अंतिम आवंटन उत्तराखंड राज्य के लिए बना रहेगा । संबन्धित कार्मिक से स्थिति के बारे में अवगत करवा दिया जाए ।
