However, a consultative committee reviewed his case and recommended against his request, finding that his plea did not align with the established guidelines for state reorganization. The Government of India has now officially endorsed this recommendation, confirming that Shri Srivastava’s final allocation will remain with Uttarakhand. This decision concludes a significant review process concerning personnel assignment within the administrative framework.

विषय: अर्थ एवं सांख्य विभाग के कार्मिक श्री अदित्य प्रकाश श्रीवास्तव, कनिष्ठ सहायक से संबन्धित रिट याचिका संख्या 6719 (S/S)/205 में माननीय इलाहाबाद उच्च न्यायालय, लखनऊ खंडपीठ के दिनांक 12-12-2007 का पारित आदेश, जो रिट याचिका संख्या 58/2006 – शेर सिंह बनाम भारत सरकार एवं अन्य से लिंक किया गया है – का निपटान।
महोदय,
मुझे उपर्युक्त विषय के संदर्भ में यह कहने का निदेश हुआ है की माननीय इलाहाबाद उच्च न्यायालय, लखनऊ खंडपीठ ने अपने दिनांक 12-12-2007 के आदेश में निम्नलिखित आदेश पारित किया था :-
“Keeping in view the circular dated 12-11-2007, the instant appeal is disposed of directing the Committee concerned to decide the appellant’s representation in accordance with law by passing a speaking and reasoned order expeditiously and preferably within a period of 3 weeks from the date of receipt of a certified copy of this order and communicate the decision to the appellant within next one month and during this period the appellant shall be allowed to discharge his duties in the State of U.P. on the posts on which he has been promoted and will be paid his salary.”
- अतः श्री अदित्य प्रकाश श्रीवास्तव, कनिष्ठ सहायक के प्रत्यावेदन पर दिनांक 17-10-2011 को आयोजित बैठक में परामर्शी समिति द्वारा विचार किया गया। समिति को बताया गया कि श्री अदित्य प्रकाश ने अपने प्रत्यावेदन में यह उलेख किया है कि उनकी नियुक्ति मृतक आश्रित के रूप में दिनांक 20-10-2000 को जनपद खौरी में हुई थी, जहां पर इनकी जगह ज़मीन है। याचौ के आश्रितों में माताजी एवं छोटा भाई है जिसके भरण पौषण कि ज़िम्मेदारी उनकी है। माताजी प्राय बीमार रहती है। उत्तराखंड राज्य में रहकर वह

परिवार कि देखभाल करने में असमर्थ है । अतः उन्हें उत्तर प्रदेश राज्य आवंटित किया जाए । श्री अदित्य प्रकाश के प्रत्यावेदन में उल्लिखित बिन्दु राज्य पुनर्गठन संबन्धित दिशानिर्देशों से आच्छादित न होने के कारण समिति द्वारा उसे अस्वीकार किए जाने की संस्तुति की गई ।
- भारत सरकार समिति की संस्तुति से सहमत है तथा तदनुसार श्री अदित्य प्रकाश श्रीवास्तव, कनिष्ठ सहायक का अंतिम आवंटन उत्तराखंड राज्य के लिए बना रहेगा । संबन्धित कार्मिक से स्थिति के बारे में अवगत करवा दिया जाए ।
