A significant administrative decision has recently been finalized regarding the allocation of a pharmacist, Mr. Mukesh Kumar, to Uttarakhand. This resolution comes after a protracted process initiated by a directive from the Hon’ble Allahabad High Court in 2009, which mandated the Union of India to consider Mr. Kumar’s representation. Despite multiple meetings of an Advisory Committee, the matter faced delays due to a lack of complete information and initial confusion, partly stemming from another individual with the same name. It was noted that other personnel, including those junior to Mr. Kumar, had already been allocated to Uttarakhand based on domicile and seniority. The Central Government, after reviewing all records provided by the Administrative Department and considering the existing final allocation order for pharmacists from 2009, has now officially allocated Mr. Mukesh Kumar to Uttarakhand. This decision aligns with his original preference and is in accordance with Section 73(2) of the UP Reorganisation Act 2000, bringing a definitive close to a long-standing personnel matter.

Sub.: Final allocation of Sh. Mukesh Kumar S/o Sh. Phaggan Lal, Pharmacist in pursuance of direction of Hon’ble Allahabad High Court.
Sir,
I am directed to say that Hon’ble Allahabad High Court in its order dated 28.08.2009 in Writ Petition No. 45353 of 2009, directed Union of India to consider the representation dated 04.02 .2008 of the petitioner and decide it by means of a reasoned and speaking order. The matter has been being accordingly considered in several meetings of the Advisory Committee but could not be decided for want of relevant information.
2. The matter was again considered in the meeting of the Advisory Committee held on 09.02.2012 and the Committee directed to find out whether besides optees, others have been allocated on domicile and juniority basis to Uttarakhand. It was reported by the Department that Sh. Mukesh Kumar S/o Sh. Phaggan Lal is yet to be finally allocated despite opting for Uttarakhand due to confusion of allocation of another Mukesh Kumar, Pharmacist to Uttarakhand.
3. It was decided in the last meeting of the Advisory Committee held on 15.01.2013 that this case is to be finalized by the Central Government on the basis of the records produced by the Administrative Department. On the basis of the records produced by the Adminstrative Department, it is seen that optee junior to Sh. Mukesh Kumar besides personnel allocated on juniority and domicile basis, has been allocated to Uttarakhand. Had Sh. Mukesh Kumar being considered for allocation at the time of final allocation, he would have been allocated to Uttarakhand as per his option.
- The Central Government has considered the matter in the light of final allocation order dated 04.06.2009 already issued in respect of pharmacist and the documents produced by the Administrative Department and has decided to allocate Sh. Mukesh Kumar S/o Sh. Phaggan Lal to Uttarakhand in terms of Section 73(2) of UP Reorganisation Act 2000 and orders accordingly.
