This document communicates the Government of India’s decision on the representation filed by Shri G.S. Dhauni, a Labour Enforcement Officer. A committee, chaired by Dr. S.K. Sarkar, reviewed Shri Dhauni’s case and found that two other individuals allocated to Uttarakhand did not belong to the Hill Sub-Cadre. While Shri Dhauni was included as a domicile of Uttarakhand in the TFAL, only two posts for Labour Enforcement Officers were available for the state, and these were already allocated to two other optees. Consequently, the committee recommended rejecting Shri Dhauni’s representation due to the unavailability of allocable posts. The Government of India has accepted this recommendation, and Shri G.S. Dhauni has been allocated to Uttar Pradesh. The concerned officers are to be informed of this decision.

Subject: Decision on the representations of Shri G.S. Dhauni in compliance of Public Service Tribunal, Dehradun directions in – Claim Petition No.05/2007 –
Sir,
I am directed to refer to the directions of the Hon’ble Public Service Tribunal, Dehradun Claim Petition No.05/2007dated 12.6.2007 and to say that the representations of Shri G. S. Dhauni, Labour Enforcement Officer were considered by the Committee headed by Dr. S.K. Sarkar, Joint Secretary, in its meeting held on 23.6.2009. The Committee found that Shri Kulashree and Shri Dimri who have been finally allocated to Uttarakhand do not belong to the Hill Sub-Cadre. Shri Dhauni was included in the TFAL as a domicile of Uttarakhand. As only 2 posts of Labour Enforcement Officer were allotted to Uttarakhand and 2 optees already stand allocated against these posts, the Committee recommended for rejection of the representation of Shri G.S. Dhauni for allocation to Uttarakhand for want of an allocable post.
The Government of India has accepted recommendation of the Committee and accordingly, Shri G.S. Dhauni, Labour Enforcement Officer stands allocated to Uttar Pradesh. Officer concerned may kindly be apprised of the position.
