Subject: Compliance of Hon’ble High Court Nainital’s directions in W.P. No.40608/2006 -Decision
on the representation of Shri Ghanshyam, Chief Pharmacist-regarding
Sir,
I am directed to refer to the direction of the Hon’ble High Court of Uttarakhand, Nainital in
W.P. No. 40608/2006 dated 02.07.2009 and to say that the representation of Shri Ghanshyam was
considered by the Committee headed by Dr. S.K. Sarker, Joint Secretary in its meeting held on
24.8.2009. The Committee found that the wife of Shri Ghanshyam was appointed in March 2005. As
the personnel appointed after the appointed day i.e. 9,11.2000 are not covered under spouse policy of
the Reorganisation Scheme, the Committee recommended to reject his representation and not to
change his allocation from UP to Uttarakhand.
The Government of India has accepted the recommendation of the Committee and accordingly
the allocation of Shri Ghanshyam, Chief Pharmacist continues to be Uttar Pradesh. Officer concerned
may kindly be apprised of the position.
