Subject: Consideration of representation of Shri Chandra Bhan, PWD in compliance of the directions dated 12/08/2009 of Hon’ble High Court of Allahabad in Writ Petition No.148/2009 – regarding
Sir,
I am directed to refer to the subject noted above and to say that Hon’ble High Court of Allahabad vide judgement dated 12.08.2009 in Writ Petition No. 148/2009 directed that “State Advisory Committee to pass appropriate orders on the representations preferred by the respective petitioners, in accordance with law, expeditiously, say within a period of one month from the date of receipt of a certified copy of this order.”
2. The representation of Shri Chandra Bhan was received, in compliance of the directions dated 12.08.2009 of Hon’ble High Court of Allahabad in Writ Petition No.148/2009, claiming that he belongs to SC Category and is domicile of Uttar Pradesh. The Committee considered his representation in its meeting held on 14.02.2011.
3. After verification of his claims regarding caste and domicile, the Committee recommended to accept his representation for revision of allocation to UP in terms of this Department’s letter No.27/26/2006-SRS dated 29.07.2008 and subsequent amendment of even number dated 24.06 .2010 regarding allocation of SC/ST personnel.
4. The Government of India has considered the representation as well as the recommendations of the Committee and decided to accept the recommendations of the Committee. Accordingly, the allocation of Shri Chandra Bhan, PWD is revised to Uttar Pradesh. The officer concerned may kindly be apprised accordingly.This will be subject to vacation of stay/disposal of any other connected court cases, if any.
