Sub.:- Compliance of direction of Hon’ble Uttarakhand High Court as per their order dated 23-05-2012 in W.P. No. 323/2011 – Prabodh Kumar Ghildiyal Vs. Union of India and others.

Sir,
I am directed to refer to order dated 23-05-2012 passed by Hon’ble Uttarakhand High Court in W.P. No. 323 (S/B) of 2011 vide which a mandamus has been issued to Respondent No.1, i.e. Secretary (Personnel), Department of Personnel and Training to take a decision regarding allocation of the cadre of the petitioner within 4 months from the date a certified copy of the order is produced before him and to say that a certified copy of the judgment has been received from the petitioner on 30-05-2012.
2. In compliance of the order of the Hon’ble Court, the Central Government has considered the matter and a comprehensive report was called for from the State Government in this direction. In response, the Government of Uttar Pradesh vide their letter dated 20-062012 has intimated that the cadre of the petitioner has already been finally allocated. They have further clarified that the petitioner was a Head Clerk (ITI/PTI) as on the appointed day and he could not be allocated to Uttarakhand as all 9 optees senior to him were allocated to Uttarakhand against 9 posts allotted to the State.
3. It has been found that the cadre of the petitioner was considered by the State Advisory Committee in its meeting held on 15-12-2003 and based on the recommendations of the Committee, 9 optee Head Constables (ITI/PTI) have been finally allocated to Uttarakhand as per Order No.12/2004 vide F.No. 27/31/2004-SRS dated 12-10-2004(copy enclosed). Since

Shri Ghildiyal does not figure in the allocation list for Uttarakhand, he stands allocated to Uttar Pradesh. Necessary steps may, therefore, please be taken for his relieving from Uttarakhand to Uttar Pradesh in pursuance of his final allocation.

आदेश 12 /2004

उत्तर प्रदेश पुनर्गठन अधिनियम, 2000 को धारा 73 की उपधारा (2) के अधीन, प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार, एतदद्वारा यह निर्देश देती है कि इस आदेश के संलग्नक में निर्दिष्ट प्रत्येक व्यक्ति, जो 9.11.2000 के ठीक पहले विद्यमान उत्तर प्रदेश राज्य के क्रियाकलापों के सम्बन्ध में सेवा कर रहा हो, एवं उपर्युक्त अधिनियम को धारा 73 की उपधारा (1) के अधीन, उत्तरवर्ती उत्तर प्रदेश राज्य या उत्तरांचल राज्य के क्रियाकलापों के सम्बन्ध में यथास्थिति, 9.11.2000 से ही अनंतिम रूप से सेवा कर रहा हो, की, उत्तरवर्ती उत्तरांचल राज्य यथास्थिति, 9.11.2000 से सेवा के लिए अन्तिम रूप से आबन्दित समझा जायेगा।

परन्तु ऐसा प्रत्येक व्यक्ति, जिसने न्यायालय से अंतरिम स्थान आदेश प्राप्त किया हो, उसका अंतिम आबंटन, न्यायालय के स्थान आदेश के तहत होने के बाद ही प्रभावी होगा अथवा जहाँ न्यायालय के द्वारा, इस सम्बन्ध में कोई निर्देश दिया गया हो, ऐसे प्रत्येक व्यक्ति का आबंटन न्यायालय के अन्तिम आदेश के अधीन होगा।

परन्तु ऐसा प्रत्येक व्यक्ति, जिसने न्यायालय से आबंटन से मुक्त रहने का स्थान आदेश प्राप्त किया हो, की न्यायालय के आदेश प्रभावी रहने तक आबन्दित नहीं समझा जायेगा।

परन्तु संबंधित सेवा / पद के शेष कर्मिकों [ जिनके 1336 कर्मिकों, जिनका आबंटन कनिष्टता के आधार पर होना उचित है, को छोड़कर ]- जिनका अंतिम आबंटन उत्तरवर्ती उत्तरांचल राज्य के लिए नहीं किया गया है, उत्तरवर्ती उत्तर प्रदेश की अंतिम रूप से आबंदित समझ जायेगी जब तक कि नियमानुसार अन्यथा निर्णय नहीं लिया जाता।
