A representation from Shri Dev Prakash Sharma of the Irrigation Department has been considered, following a High Court directive. It was found that Shri Sharma initially submitted an option for Uttarakhand but later submitted a valid option for Uttar Pradesh during the eligible period. An advisory committee reviewed the case and concluded that Shri Sharma should be allocated to Uttar Pradesh based on his valid option. The Government of India has accepted this recommendation, and Shri Dev Prakash Sharma, Assistant Engineer (Mechanical), has been officially allocated to the State of Uttar Pradesh.

Subject: Consideration of representation of Shri Dev Prakash Sharma, Irrigation Department in terms of directions dated 12-08-2010 of Allahabad High Court, Lucknow Bench in W.P. No.839/2006 by the Advisory Committee in its meeting held on 15-06-2011.
Sir,
I am directed to refer to the subject noted above and to say that in W.P. No.839/2006, the Hon’ble Allahabad High Court, Lucknow Bench in their order dated 12-08-2010 has directed “Respondents to take a decision in accordance with law if not already taken and communicate the decision so taken expeditiously preferably within a period of two months from the date certified copy of the order is produced and communicate the same.”
2. During the meeting, Departmental representative informed that Shri Dev Prakash Sharma had not submitted any option in the prescribed proforma in his option dated 25-08-2000. This option was for the State of Uttarakhand. Thereafter, he submitted another option for the State of U.P.durins the period 20-09-2000 and 15-06-2001, i.e. the period valid for submitting options. While considering his allocation, S. a Advisory Committee erroneously allocated him Uttarakhand. The representative further informed that he cannot be allocated under juniority category as he is senior amongst the three employees allocated under juniority category.
3. The Committee considered the statement made by the Departmental representative and arrived at the conclusion that he is to be allocated to the State of Uttar Pradesh as per his valid option and recommended accordingly.
4. The Government of India has accepted the recommendation of the Committee and accordingly, the allocation of Shri Dev Prakash, Assistant Engineer (Mechanical) is hereby revised to Uttar Pradesh.5. Officer concerned may kindly be apprised of the decision.
