This document details the reallocation of an Assistant Binder, Mr. Kailashchandra Joshi, from Uttarakhand to Uttar Pradesh. विषय:- माननीय उच्च न्यायालय, उत्तरप्रदेश, लखनड बेच में दायर रिट याचिका संख्या 5377 (एस०/एस०) द्वारा पारित निर्णय दिनांक 6 नम्बर 2012 के अनुपालन में दिनांक 18-07-2014 को आयोजित परामर्शीय समिति की बैठक में श्री कैलाशचंद्र जोशी, सहायक बाइंडर, (वर्तमान में बाइंडर), का उत्तरप्रदेश राज्य आवंटन के अनुशंसा पर विचार।
महोदय,
उपर्युक्त विषय के संबंध में मुझे यह कहने का निदेश हुआ है कि श्री, कैलाशचंद्र जोशी, सहायक बाइंडर, का माननीय उच्च न्यायालय, उत्तरप्रदेश, लखनउ बेच ख्वायर रिट याचिका संख्या 5377 (एस०)/(एस०), द्वारा पारित निर्णय दिनांक 6 नम्बर 2012 के अनुपालन में उत्तरप्रदेश राज्य पुनरावंटन हेतु परामर्शी समिति के आयोजित बैठक दिनांक 18-07-2014 में विचार किया गया । समिति को अवगत करवाया गया कि माननीय उच्च न्यायालय, उत्तरप्रदेश, लखनड बेच में दायर रिट याचिका संख्या 5377 (एस०)/(एस०) के संबंध मे कैलाशचंद्र जोशी, सहायक बाइंडर, जो बाईपोलर अफ्फ़ेक्टिव डिसऑर्डर से एसित है के संबंध में दिनांक 6-11-2012 को निम्न प्रभावी आदेश पारित किया था:
“In this view of the matter, the writ petition is allowed. The impugned order dated 27.11.2012 as contained in Annexure-1 to the writ petition is hereby quashed with direction that opposite party no. 5 shall send all the relevant documents including petitioner’s medical certificate issued by the State Medical Board within a period of 15 days. Therefore, opposite party No. 1 shall take decision in accordance with law reconsidering the representation of petitioner and pass appropriate orders expeditiously, say, within a period of six Weeks’s from the date of receipt of certified copy of the order alongwith copy of the representation.
The petitioner is directed to serve the certified copy of the order on opposite party No. 5 within seven days from today and also inform the other opposite parties of the court’s order. Till the final decision is taken by the opposite parties petitionershall be allowed to continue in the State of Uttar Pradesh on the post on which he is/was working.”
20 उपरोक्त आदेश के अनुपालन में समिति को यह सूचित किया गया कि मेडिकल बोर्ड ने इस संबंध में निम्नलिखित अनुशंसा की है:
“That the petitioner is suffering with Bipolar Affective Disorder currently Highpromenia. His ideas score is 8 (eight). He is required to undergo treatment with regular checkup throughout life.”
अतः सीमिति द्वारा संस्तुति की गई कि इन्हें माननीय उच्च न्यायालय के उपरोक्त आदेश के अनुपालन मे उत्तर प्रदेश आवंटित किया जाये।
- भारत सरकार परामर्शी समिति की उपरोक्त संस्तुति से सहमत है एवं मेडिकल बोर्ड की उपरोक्त अनुशंसा के उपरांत, श्री कैलाशचंद्र जोशी, सहायक बाइंडर का राज्य पुनरावंटन माननीय उच्च न्यायालय, उत्तरप्रदेश, के अनुपालन मे उत्तराखंड से उत्तर प्रदेश राज्य के लिये किया जाता है।

कार्मिक को इस निर्णय के बारे में सूचित किया जाए एवं तदनुसार उपरोक्त आदेश पारित किया जाए।
