The Central Government drawing powers conferred under Section 73 (2) of the UP Reorganisation Act, 2000 hereby allocates the PCS officers (list enclosed), who were working in connection with the affairs of Government of Uttar Pradesh immediately before 09.11.2000 and were recommended for allocation to Uttarakhand / Uttar Pradesh by the SAC in its meeting dated 04.12.2002, to Uttarakhand / Uttar Pradesh with effect from 09.11.2000.

  1. In case of officers expired / retired from service before final allocation, pensionary benefits shall be sanctioned by the successor State Government from where the employee has relinquished office on account of retirement/ death as per clarification issued vide letter F.No.28/07/2002 dated 07.03.2002 (copy enclosed).

  2. This issues consequent upon dismissal of different WPs filed by the officers concerned by the Hon`ble High Courts of Allahabad / Lucknow on different dates as mentioned against their names.

Subject: Clarification regarding sanction of pensionary benefits to the employees affected by the UP Reorganization Act, 2000

Sir,

The undersigned is directed to say that this Department has been receiving queries from State Governments regarding payment of pensionary benefits to State service personnel other than All India Services who have either expired or retired or are due retirement after the appointed day but have not been finally allocated to service to any of the successor States.

It is clarified that while normally pensionary benefits are to be sanctioned by the successor State Government to which a State Service Personnel is finally allocated to service but in cases as above, the benefits have to be sanctioned by the successor State Government from where the employee has relinquished the office on account of retirement/death. As regards apportionment of liability in respect of pensions, the same shall be guided by the VIIIth Schedule of the UP Reorganization Act, 2000.
