This document details the final allocation of Shri Gayyur Ali, a Fireman, to the state of Uttarakhand. Initially appointed in Uttar Pradesh in 1989, his services were terminated by Uttarakhand in 2003 following disciplinary proceedings. Shri Gayyur Ali was appointed as Fireman on 1.11.1989 in the Fire Service Department in the undivided State of Uttar Pradesh. Subsequent to bifurcation of the State of Uttar Pradesh into the Successor States of Uttar Pradesh and Uttarakhand on 9.11.2000 as per the provisions of the UP Reorgnisation Act, 2000, Shri Gayyur Ali, Fireman was serving in the newly created Successor State of Uttarakhand.
2. Before considering and issuing final allocation orders to the Fireman Category in the Fire Service Department on 11.11.2005 in accordance with the provisions of the Act and the guidelines framed thereunder, the services of Shri Gayyur Ali, Fireman was terminated on 22.9.2003 by the Successor State of Uttarakhand based on finalised disciplinary proceedings against him. In compliance of the Order dated 13.06.2013 of the Public Service Tribunal, Uttarakhand in the Direction Petition No. 41 of 2012 filed by Shri Gayyur Ali challenging his dismissal from service, the Successor State of Uttarakhand had reinstated him into service on 02.09 .2013 with all consequential benefits.
3. Subsequent to his reinstatement in service on 02.09 .2013 , the Successor State of Uttarakhand vide their letter dated 07.11.2020 had recommended for his allocation to Uttarakhand based on his representations submitted in 2015 and 2017 with the contention that he was not considered for allocation as per the provisions of the UP Reorganisation Act, 2000 and the guidelines framed thereunder. On receipt of the communication of Govt. of Uttarakhand, the matter was taken up with the Nodal Department (UPRCD) and the Administrative Department (Home) of Govt. of Uttar Pradesh for their views and comments. The Nodal Department (UPRCD) Govt. of Uttar Pradesh vide their letter dated 19.12.2022 has conveyed the concurrence of the Administrative Department (Home) for allocation of Shri Gayyur Ali, Fireman to Uttarakhand.
4. Considering the request of the Successor State of Uttarakhand and concurrence of Govt. of Uttar Pradesh, the Central Government, in exercise of powers conferred under Section 73(2) of the Uttar Pradesh
Reorganization Act, 2000 hereby finally allocate Shri Gayyur Ali, Fireman, to the Successor State of Uttarakhand with effect from 09.11.2000 (the appointed day).
