The 25th meeting of Advisory Committee, Madhya Pradesh was convened at 11:30 AM on 29.10.2014 at Madhyanchal Bhawan, New Delhi. The Chairperson of the Committee, Ms. Archana Varma, Joint Secretary (AT&A), DOPT, Govt. of India could not attend the meeting due to some exigencies and she directed Ms. K. Kipgen, Director (SR) to chair the Committee on her behalf. Accordingly, the Committee was chaired by Ms. K. Kipgen, Director (SR) to consider the representations of the petitioners/employees of erstwhile State of Madhya Pradesh. The list of attendees is enclosed at Annexure-A.
- Shri R. K. Chaturvedi, Resident Commissioner, M.P. Bhawan, Govt. of M.P. on behalf of Principal Secretary, Department of General Administration, Govt. of M.P. welcomed the Members and other attendees in the meeting and thereafter took up the agenda of the meeting for discussion. At the outset, the Committee observed that although final allocation was made 12 years ago, yet representations for revision of State allocation under medical hardships, spouse policy etc. are still being received from the employees of erstwhile State of M.P. It was observed that the bifurcation of the States took place 14 years ago and in this regard the Committee accordingly instructed both the State Governments of M.P. and Chhattisgarh to provide all the details of deferred cases and also advised the State Governments to draw a deadline for submission of new representations.

The Committee took a serious view in respect of cases which have been repeatedly deferred for want of complete or specific information. The Committee desired that all such cases should be re-examined by both the State Governments of M.P. and Chhattisgarh with their mutual consent so that an amicable decision could be arrived at. A detailed proposal in this regard was desired and be submitted within one month from the date of circulation of minutes.

The Committee also observed that about 200 cases are pending in High Courts of Madhya Pradesh and Chhattisgarh and their updated status is not available with the Central Government. A list of such 32 cases (Annexure-B) was placed before the Committee by DOPT which was later handed over to the Department of General Administration, Government of M.P. for taking up the matter with concerned Departments. It was brought to the notice of the Committee that in spite of several reminders, the concerned Departments have not yet furnished their comments/information to the Central Government. The Committee desired that:
1(i) Updated status of all the cases pending in the High Courts will be furnished to the Central Government by the concerned Departments within one month from the circulation of the minutes.
(ii) Compliance report/information in respect of above referred 32 cases will be furnished to the Central Government within one month.
(iii) Concerned Departments will instruct the State Governments Counsels handling these cases to get all the pending cases mentioned before the Courts and take necessary steps for expediting their disposal.
- As regards representations for revision of State allocation, the Committee considered 53 cases in total. Details are given below: –

Shri Kushwaha has protested against his allocation in general category whereas he actually belongs to OBC category. He has requested for re-allocation to Madhya Pradesh under OBC category.
The Committee noted that while disposing of W.P. No. 1165/2006 on 03.10.2007, the Hon’ble High Court directed that:”the petitioner belongs to OBC category hence he was entitled to be placed in the list of OBC category employees not in general category. The reason put forth by respondents that because petitioner was appointed in the year 1983 hence he was not placed in the list of OBC category candidates is illegal, because when the petitioner belongs to OBC category by caste, he is entitled to get the benefit of OBC category. Hence the allocation of the petitioner is illegal. Consequently, the Hon’ble Court allowed the petition and quashed the impugned orders dated 11.09.2002 (allocation order to Chhattisgarh) and 10.01.2006 with regard to the petitioner.”
Since the concerned State Government has not preferred an appeal against the M.P. High Court’s order dated 03.10.2007 and it time barred now, the Committee recommended compliance of the Court’s order while observing that allocation on the basis of OBC status is not permissible under the guidelines. It recommended allocation of Shri Ram Lal Singh Kushwaha, SADO to Madhya Pradesh as an exceptional case and not to be quoted as precedent.
| 2. | Shri L. S. Rajput, RAEO, D/o Farmer Welfare and Agriculture Development (WA No. 18/2013) | In compliance of directions dated 06.03.2014 of Hon’ble High court of M.P., Bench at Gwalior in W. A. No. 18/2013, the old representation of Shri Rajput was considered by the Committee.
Shri Rajput contended that his juniors were allocated to Madhya Pradesh. He has claimed for his allocation to M.P. in OBC category instead of general category.
The Administrative Department has clarified that his juniors Shri B K Sharma, Shri Ajay Aggarwal, Shri R K Jain and Shri Mohabat Singh were allocated to Madhya Pradesh under mutual transfer policy. Besides, he is not |

| 3. | Shri Watan Jadhav, RAEO, D/o Farmer Welfare and Agriculture Development (Representation) | The Administrative Department of Shri Jadhav and Shri Kumhar informed that they are Non-State Cadre employees. Non-State Cadre employees stood allocated to the State where they were working as on the appointed day i.e. 01.11.2000. The Committee noted that no separate orders for allocation of such Non-State cadre employee were issued. Therefore, consideration of allocation of Non-State Cadre employee does not fall within the purview of Advisory Committee. As such, the Committee did not consider their representations and the same were dropped from the agenda. | ||||
| 4. | Shri Sumran Lal Kumhar, RAEO, D/o Farmer Welfare and Agriculture Development (Representation) | Shri Narbhariya has represented that he belongs to OBC category, is domicile of M.P. and had opted for M.P. but allocated to Chhattisgarh. | The Administrative Department of Shri Narbhariya informed that he has been working in the State of Chhattisgarh since 24.10.2002 after being relieved from State of M.P. | In the light of above facts, the Committee recommended rejection of representation of Shri Atar Singh Narbariya, RAEO as none of the grounds raised by him are covered under the guidelines of allocation. | ||||||

No. 6775/2006) | These cases have been deferred since 15th meeting of the Committee i.e. 29.12.2010 for want of specific information from the concerned Department. All these cases were placed before the Committee in compliance of Court’s directions dated 15.11.2011, 28.0.20012, 28.04.2008, 01.02.2006, 04.02.2008 and 15.12.2010 respectively. The Administrative Department informed that there is shortage of AMOs in State of Madhya Pradesh. Therefore, it is of view to retain all these AMOs in the State of Madhya Pradesh despite their allocation to Chhattisgarh. It was further informed that most of them are going to retire within one or two years. Since the matter is being repeatedly deferred and specific comments by Administrative Departments have not yet been furnished, the Committee took serious note of it and expressed its displeasure. In the light of above position, the Committee desired that both the State Governments should arrive at an amicable decision in all these cases. Shri Sharma has contended that his junior Shri Manoj Jain was allocated to M.P. and his wife Smt. Vijay Lata Sharma is working as Shiksha Karmi Verg I in Government Higher Secondary School, Bhonti, Shivpuri, M.P. The Administrative Department informed that his wife namely Smt. Vijay Lata Sharma is working as ‘Sanvida Karmi’. She is not a permanent government employee. With regard to allocation of his junior Shri Manoj Jain to M.P., they sought time to further examine the matter. In the light of above facts, the Committee desired that the position be verified and intimated within two weeks to the Central Government with detailed comments. In the light of the above facts, the Committee considered his representation and recommended revision of allocation of Shri Narmada Prasad Shilpi from Chhattisgarh to M.P. under revised guidelines dated 24.06 .2010 for allocation of SC/ST employees as he belongs to SC category and is domicile/optee of M.P. The Committee further recommended correction of name of Shri Narmada Prasad Shilpi in place of Shri Narendra Prasad Shilpi in final allocation order issued by the Central Government. |

No. 225/2012) | In compliance of directions dated 04.05.2012 of Hon’ble High Court of M.P., Bench at Gwalior, the representation of Shri Khare was considered by the Committee. Shri Khare has contended that his wife Smt. Rashmi Khare is working as Assistant grade II in office of Sahayak Bhu Jalwid, Bhind, M.P. He has also contended that he was receiving the pay scale of Rs. $6500-9100 /-$ but was allocated to Chhattisgarh in pay scale of Rs. 8000-13500/which was wrong. The Administrative Department informed that his wife namely Smt. Rashmi Khare has taken Voluntary Retirement. The Committee observed that the Hon’ble High Court in its order dated 04.05.2012 directed that the matter be remitted to Union of India for consideration of allocation of Shri Khare on merit and taking into account the order dated 24.09 .2009 passed by the State of M.P., granting retrospective proforma promotion to the petitioner/respondent herein from the cadre of Sub-Engineer to Assistant Engineer w.e.f. 04.12.1989. The Administrative Department informed |
that in compliance of above directions of the Court, the proforma promotion of Shri Khare from the cadre of Sub-Engineer to Assistant Engineer was considered and his seniority has been fixed below Shri TC Panchal, Assistant Engineer (Sr. No. 10) and above Shri HN Vaidya, Assistant Engineer (Sr. No. 11). They further clarified that his juniors namely Shri HN Vaidya, Shri RB Rai, Shri DK Bhavsar, Shri AR Pawar, Shri SH Khan, Shri Rajesh Joshi and Shri Sudhir Deshmukh were allocated to M.P. as per their option in General category. In the light of above facts, the Committee recommended allocation of Shri Mohan Sharan Khare, Assistant Engineer to Madhya Pradesh and deletion of his name from allocation order of Sub-Engineers. Fresh allocation order would be issued accordingly by the Central Government after obtaining approval of the competent authority. |

Shri Bhagat submitted a representation for revision of his allocation from M.P. to Chhattisgarh. He is domicile and optee of Chhattisgarh. The Administrative Department, Government of Chhattisgarh has given its no objection to his re-allocation to Chhattisgarh. Government of M.P. has also given its no objection and consent on revision of allocation of Shri Bhagat from M.P. to Chhattisgarh. In the light of above, the Committee recommended revision of allocation of Shri Bantalu Ram Bhagat, Platoon Commander from M.P. to Chhattisgarh. |

The Committee noted that a copy of representation of Shri Varma had already been forwarded to Administrative Department by DoPT. Since the matter is being repeatedly deferred and comments from Administrative Department have not been furnished, the Committee took serious note of it and expressed its displeasure. In the light of above position, the Committee desired that the position be verified and intimated within two weeks to the Central Government with detailed comments. The Administrative Department of Shri Sonare submitted a representation for revision of allocation from Chhattisgarh to Madhya Pradesh under revised guidelines for SC/ST employees.
Shri Sonare belongs to SC category, is domicile of M.P. and had opted for Chhattisgarh. On confirmation of domicile of Shri Sonare i.e. Madhya Pradesh by Administrative Department, the Committee recommended revision of allocation of Shri Sonare from Chhattisgarh to M.P.
However, during drafting the minutes of the meeting, Department of Personnel & Training, Government of India was in receipt of representation dated 31.10.2014 submitted by Shri Sonare. Shri Sonare has requested for withdrawal of his earlier representation for his re-allocation to Madhya Pradesh.
Accordingly, a reference is being made to the State Government for confirmation.

No. 386/2007) | In compliance of directions dated 19.03.2014 of Hon’ble High Court of M.P., Bench at Gwalior, the representation of Shri Bhadoriya was considered by the Committee. Shri Bhadoriya has contended that his junior Shri K K Sharma and Shri Hemant Kumar Pathak were allocated to M.P. and some juniors were not given the benefit of ACP and allocated to M.P. in lower pay scale.
The Administrative Department informed that Shri K K Sharma and Shri Hemant Kumar Pathak were allocated to M.P. on mutual transfer basis. They have further clarified that nine junior Assistant Veterinary Surgeons were given the benefits of ACP after completion of twelve years i.e. after 23.09.2000.
The Committee desired that allocation of his juniors to M.P. in lower pay scale may be verified. Name of all juniors to Shri Bhadoriya along with date of their joining of service and order of grant of ACP be furnished by Administrative Department to the Central Government within two weeks. The Committee observed that Smt. Manju Shukla was allocated to Chhattisgarh as per her option. In the light of above facts the Committee recommended that appeal be preferred before the Hon’ble Court by the State Government as well as Central Government. The Committee further recommended that a copy of writ petition filed by the petitioner along with Annexures will be furnished to the Central Government within one week by the Administrative Department. The Committee also observed that appeal against the directions dated 03.09 .2013 has not yet been preferred by the State Government and it has become time barred. Therefore, legal opinion in the matter would be sought from the State Government Counsel. A report in this regard be submitted to the Central Government within one month. |
