Smt. G. Jayanthi, Joint Secretary (Estt.), D/o Personnel \& Training, Govt. of India chaired a meeting, held through video conference, with the officers of Government of Madhya Pradesh and Government of Chhattisgarh, to discuss the representations submitted by the employees of the successor States of Madhya Pradesh and Chhattisgarh, carved out of the erstwhile State of Madhya Pradesh, seeking revision of their allocation already made and other related issues.
2. At the outset, Joint Secretary (Estt.), DoPT, drew attention of the participants to the decision of the Advisory Committee in its $27^{\text {th }}$ meeting held on 06.10 .2016 to retain State Government employees, who are due for retirement within two years from 01.04.2016 i.e. till 31.03 .2018 , in the State of their existing posting and subsequent decision of the Committee in its $28^{\text {th }}$ meeting held on 06.03 .2019 to extend the cut-off date for such retention till 31.03 .2020 in view of enhancement of the retirement age from 60 years to 62 years in both the States i.e. Madhya Pradesh and Chhattisgarh. She drew attention to the judgement dated 05.03 .2020 of the Hon’ble High Court of Madhya Pradesh (Gwalior Bench) in WP No. 1361/2014 and 17 other connected Writ Petitions wherein the Hon’ble High Court observed that about 20 years have already elapsed since the time of original allocation and during this period the petitioners have been rendering their services in the State of Madhya Pradesh. The Hon’ble Court further directed the Petitioners to file fresh representations for their reallocation and directed that the Advisory Committee shall dwell upon the question of retaining services of the petitioners in the State of Madhya Pradesh in view of efflux of time and pass a self-contained speaking order, in accordance with law. Given the position that a number of the petitioners are left with less than two years for retirement, it has been decided with the concurrence of the both the State Governments that those petitioners/employees who are due to retire within two years as on the date of the meeting may be retained in the State they are serving as on date.
3. As regards the petitioners who are left with more than two years’ service for retirement as on the date of the meeting and where both the State Governments are agreeable to the revision of allocation of such petitioners, Joint Secretary (Estt.), DoPT invited attention to the DoPT’s letter No. 14/279/2002-SR(S) dated 08.06.2006 wherein it was conveyed to the State Governments that it is open to them to consider such requests for revision of allocation based on broad consensus arrived at between them, inter-alia, either by defining the terms and conditions for such consideration or by framing suitable rules for the purpose. These cases will be considered separately on case-to-case basis in consultation with both the State Govts.
4. In all 54 cases were considered in the meeting. These cases, along with decisions taken thereon, are indicated in the Annexure. In a number of cases where the petitioners have been considered for revision of their allocation, the State Governments conveyed their ‘no objection’/consent to such revision in the meeting.
