Amendment to All India Services (Death-cum-Retirement Benefits) Rules, 1958

A

This notification from the Ministry of Personnel, Public Grievances and Pensions details amendments to the All India Services (Death-cum-Retirement Benefits) Rules, 1958. The key changes, effective from January 1, 1996, stipulate that the pension calculated will not exceed fifteen thousand rupees per month. Furthermore, the minimum pension in any case will not be less than fifty percent of the minimum of the revised scale of pay for the post last held by the member at retirement. The family pension has also been clarified to be no less than thirty percent of the minimum pay in the revised scale. These amendments are being made to align with a government decision to revise pension calculations and do not adversely affect existing pensioners.

NOTIFICATION

New Delhi, the 14th January, 1999

G.S.R. 35(E).—In exercise of the powers conferred by sub-section (1) read with sub-section (1A), of Section 2 of the All India Services Act, 1951 (6 of 1951), the Central Government, after consultation with the Governments of the States concerned, hereby makes the following rules further to amend the All India Services (Death-cum-Retirement Benefits) Rules, 1958, namely:—

  1. (1) These rules may be called the All India Services (Death-cum-Retirement Benefits) Amendment Rules, 1999.

(2) They shall be deemed to have come into force on the 1st day of January, 1958.

  1. In the All India Services (Death-cum-Retirement Benefits) Rules, 1958.—(a) in rule 18, in sub-rule (1), in clause (b),—
