Amendment to Indian Police Service (Recruitment) Rules, 2011

The government has amended the Indian Police Service (Recruitment) Rules, 1954, through the Indian Police Service (Recruitment) Amendment Rules, 2011. These amendments, effective from their publication in the Official Gazette, modify rule 4 of the principal rules. Previously, recruitment was through a specific method, now it will include recruitment via limited competitive examination and promotion of State Police Service members. A new rule, rule 8, has been inserted to outline the process for recruitment through limited competitive examination. This examination will be held at intervals determined by the Central Government in consultation with the Commission. The examination will be conducted according to regulations made by the Central Government in consultation with the Commission and State Governments. Appointments will be subject to orders regarding special representation for Scheduled Castes, Scheduled Tribes, and Other Backward Classes. Candidates from these categories declared suitable for appointment may be appointed to reserved vacancies. Importantly, candidates from these categories who qualify on merit without reservation benefits will be appointed against unreserved vacancies.

स.कार.नि. 660(अ).—अखिल भारतीय सेवाएं अधिनियम, 1951 (1951 का 61) की धारा 3 की उप-धारा (1) द्वारा प्रदत्त शक्तियों को प्रयोग करते हुए, केन्द्र सरकार संबंधित राज्य सरकारों के परामर्श करने के उपरान्त भारतीय पुलिस सेवा (भर्ती) नियमावली, 1954 में संशोधन करने के लिए एतद्वारा निम्नलिखित अगले नियम बनाती है, अर्थात् :—

  1. (1) इन नियमों को भारतीय पुलिस सेवा (भर्ती) संशोधन नियमावली, 2011 कहा जाएगा।

(2) ये सरकारी राजपत्र में इनके प्रकाशन की तिथि से प्रवृत्त होंगे।

  1. भारतीय पुलिस सेवा (भर्ती) नियमावली, 1954 (इसके बाद मुख्य नियमों के रूप में संदर्भित) में नियम 4 में उप-नियम (i) में खंड (ख) के लिए निम्नलिखित खंड प्रतिस्थापित किए जाएंगे, अर्थात् :—

“(ख) सीमित प्रतियोगी परीक्षा द्वारा;

(ग) किसी राज्य पुलिस सेवा के सदस्यों की पदोन्नति द्वारा।”

  1. मुख्य नियमों में, नियम 7 के बाद निम्नलिखित नियम अंत:स्थापित किए जाएंगे, अर्थात् :—

“1. सीमित प्रतियोगी परीक्षा द्वारा भर्ती—(1) इस सेवा में भर्ती के लिए सीमित प्रतियोगी परीक्षा ऐसे अद्वितीय पर आयोजित की जाएगी जो केन्द्र सरकार समय-समय पर आयोग और राज्य सरकारों के परामर्श से निर्धारित करेगी।

(2) यह परीक्षा आयोग द्वारा ऐसे विनियमों के अनुसार आयोजित की जाएगी जो केन्द्र सरकार समय-समय पर आयोग और राज्य सरकारों के परामर्श से बनाएगी।

(3) इस सेवा में नियुक्ति अनुसूचित जाति, अनुसूचित जन जाति और अन्य पिछड़े वर्गों के लिए सेवा में विशेष प्रतिनिधित्व के संबंध में केन्द्र सरकार द्वारा राज्य सरकारों के परामर्श से समय-समय पर जारी आदेश की शर्त के अधीन होगी।

(4) प्रशासन की दक्षता को बनाए रखने को पूरी तरह ध्यान में रखते हुए आयोग द्वारा इस सेवा में नियुक्ति के लिए उपर्युक्त घोषित अनुसूचित जाति, अनुसूचित जन जाति और अन्य पिछड़ा वर्ग के अध्यक्षियों को अनुसूचित जाति, अनुसूचित जन जाति और अन्य पिछड़ा वर्ग, जैसा भी मामला हो, के अध्यक्षियों के लिए आरक्षित रिक्तियों पर नियुक्त किया जाएगा।

बशर्ते कि अनुसूचित जाति अथवा अनुसूचित जन जाति अथवा अन्य पिछड़ा वर्ग के अध्यक्षों और इस सेवा के लिए नियुक्ति हेतु आयोग द्वारा उपयुक्त घोषित अध्यक्षियों को अनारक्षित रिक्तियों पर नियुक्त किया जाएगा, यदि वे आरक्षण के लाभ का सहारा लिए बिना अपनी मेरिट के आधार पर

NOTIFICATION

New Delhi, the 29th August, 2011
G.S.R. 660(E).-In exercise of the powers conferred by sub-section (1) of Section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government, after consultation with the State Governments concerned hereby makes the following rules further to amend the Indian Police Service (Recruitment) Rules, 1954, namely :-

  1. (1) These rules may be called the Indian Police Service (Recruitment) Amendment Rules, 2011.
    (2) They shall come in to force from the date of their publication in the Official Gazette.
  2. In the Indian Police Service (Recruitment) Rules, 1954 (hereinafter referred to as the principal rules), in rule 4, in sub-rule (1), for clause (b), the following clauses shall be substituted, namely :-
    (b) by limited competitive examination;
    (c) by promotion of members of a State Police Service.”
  3. In the principal rules, after rule 7 , the following rule shall be inserted, namely :-
    *8. Recruitment by limited competitive examination.-(1) The limited competitive examination for recruitment to the Service shall be held at such intervals as the Central Government may, in consultation with the Commission, from time to time determine.
    (2) The examination shall be conducted by the Commission in accordance with such regulations as the Central Government may from time to time make in consultation with the Commission and the State Governments.
    (3) Appointments to the Service shall be subject to order regarding special representation in the Service for the Scheduled Castes, the Scheduled Tribes and Other Backward Classes issued by the Central Government from time to time in consultation with the State Governments.
    (4) Candidates belonging to the Scheduled Castes, the Scheduled Tribes and Other Backward Classes declared by the Commission to be suitable for appointment to the Service with due regard to the maintenance of efficiency of administration may be appointed to the vacancies reserved for the candidates of the Scheduled Castes, the Scheduled Tribes or Other Backward Classes, as the case may be : Provided that candidates belonging to the Scheduled Castes or the Scheduled Tribes or Other Backward Classes and declared by the Commission to be suitable for appointment to the service shall be appointed against unreserved vacancies, in case they qualify for appointment to the Service based on their merit without recourse to the benefit of reservation.”
