Indian Forest Service (Pay) Fifth Amendment Rules, 2012

New rules have been issued to amend the Indian Forest Service (Pay) Rules, 2007. These amendments, known as the Indian Forest Service (Pay) Fifth Amendment Rules, 2012, will come into effect upon their publication in the official gazette. A key change involves the substitution of sub-rule (8) in rule 6. The new sub-rule clarifies the conditions under which service periods cleared for proforma promotion in a pay band or time scale will count towards the initial fixation of pay and increments. This applies when a member of the service is reverted to the cadre and appointed to a post in the said scale. For this to be effective, the proforma promotion must have been granted while considering specific points: the concerned member must have been approved by the State Government for appointment to the scale during the relevant period; all senior members of the Service (excluding those deemed unfit) must have started drawing pay in that scale on or before the date of the proforma promotion; and a vacancy in the higher grade must have been available in the cadre at the time of the member’s repatriation from deputation.

G.S.R. 501(E)- In exercise of the powers conferred by sub-section (1) of section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government after consultation with the Governments of the States concerned, hereby makes the following rules further to amend the Indian Forest Service (Pay) Rules, 2007, namely:-
2312 GJJ12 -21. (1) These rules may be called the Indian Forest Service (Pay) Fifth Amendment Rules, 2012.
(2) They shall come into force on the date of their publication in the official gazette.
2. In rule 6 of the Indian Forest Service (Pay) Rules, 2007 (hereinafter referred to as the said rules), for sub-rule (8), the following sub-rule shall be substituted, namely :-
(8) In case of a member of the Service being cleared for proforma promotion in a pay band / time scale, the period of service covered by the proforma promotion shall, on his subsequent reversion to the cadre and appointment to a post in the said scale, count towards the initial fixation of pay and increments subject to the condition that proforma promotion has been granted to him while considering the following points, namely:-
(i) such member of the Service concerned should have been approved by the State Government for appointment to the said scale during the relevant period;
(ii) all the members of Service senior to such member (excluding those considered unfit) should have started drawing pay in that scale on or before the date from which the proforma promotion is granted to him;
(iii) vacancy in higher grade, in which member of Service has been granted proforma promotion, should be available in the cadre at the time of his repatriation from deputation.”
