Dated the $28^{\text {th }}$ December 2015 ORDER In compliance to the order dated 02.02 .2015 passed by Hon’ble High Court of Rajasthan, Jaipur Bench in DB Civil Writ Petitions No. 7472/2013, 7118/2013, 7136/2013 and 20819/2013 together with order dated 4.4.2013 passed by Hon’ble Central Administrative Tribunal, Jaipur Bench in OA Nos. 810/2012 and 80/2013 and in partial modification of this Department’s Notification No. 14015/19/2012-AIS-(I)A dated 31.12.2012, twenty one (21) officers were granted notional appointment to IAS from their respective select lists for the select lists 1996-97 to 2001 and nine (09) officers for the select lists 2003 to 2008 vide this Department’s notification No. 14015/19/2013-AIS(I) dated 1.7.2015 and dated $15^{\text {th }}$ September 2015 respectively. Accordingly select lists for the year 2002 to 2008, 2009 to 2011 and 2012 to 2014 were re-notified vide our notifications Nos.14015/19/2012-AIS(I) dated $15^{\text {th }}$ September, 2015, $23^{\text {rd }}$ October, 2015 and $23^{\text {rd }}$ October, 2015 respectively. 2. The Government of Rajasthan sent a proposal dated 26.10 .2015 for fixation of seniority/year of allotment of promotee IAS officers appointed on the basis of inclusion of their names in the select lists of 1994-95, 1996-97, 1998, 1999, 2003, 2005, 2006, 2007, 2008, 2009, 2010, 2011, 2013 and 2014. 3. It may be mentioned that select list of 1994-95 which includes the name of Shri Ramesh Kumar Jain was reviewed and notified vide this Department’s Notification No. 14015/19/2012-AIS(I)-B dated $31^{\text {st }}$ December, 2012. Further, seniority/year of allotment of Shri Ramesh Kumar Jain included in the original select list of 1994-95 has already been fixed as 1990 vide this department’s notification dated 16.2.2000. Therefore, seniority /year of allotment of Shri Jain is not required to be re-fixed. However, seniority/year of allotment of officers appointed on the basis of select list of 1997 onwards is to be fixed.
4. All the select lists have been prepared following the ratio laid down by the Hon’ble High Court of Punjab and Haryana and confirmed by Hon’ble Supreme Court of India in the matter of Shri Praveen Kumar. Therefore, seniority/year of allotment is required to be fixed in accordance with the provisions of IAS (Regulation of Seniority), Rules, 1987 as amended on 18.4.2012. As per relevant rules, weightage formula is as under:-

  6.1 As per Rule 4 of the IAS (Regulation of Seniority) Rules, 1987, the officers whose names have been mentioned at SI. No. 1 to 5 of the select list of 1996-97 shall be placed below Shri Rajat Kumar Mishra, the junior most RR IAS officer of 1992 batch and above Shri Tanmay Kumar, the senior most RR IAS officer of 1993 batch of Rajasthan cadre.

No. 1 to 9 of the select list of 1997 shall be placed below Shri Ram Niwas Meena, the junior most promotee IAS officer of 1992 batch and above Shri Tanmay Kumar, the senior most RR IAS officer of 1993 batch of Rajasthan cadre.

Barwad, the junior most promotee IAS officer of 1992 batch and above Shri Tanmay Kumar, the senior most RR IAS officer of 1993 batch of Rajasthan cadre.

  9.1 As per Rule 4 of the IAS (Regulation of Seniority) Rules, 1987, the officers whose names have been mentioned at SI. No. 1 to 4 of the select list of 1999 shall be placed below Ms. Aparna Arora the junior-most RR recruit IAS officer of 1993 batch and above Shri Kuldeep Ranka, the senior most RR IAS officer of 1994 batch of Rajasthan cadre.

No. 1 of the select list of 2000 shall be placed below Shri Gajendra Singh the junior most promotee IAS officer of 1993 batch and above Shri Kuldeep Ranka, the senior most RR IAS officer of 1994 batch of Rajasthan cadre.

  11.1 As per Rule 4 of the IAS (Regulation of Seniority) Rules, 1987, the officers whose names have been mentioned at SI. No. 1 of the select list of 2001 shall be placed below Shri Badri Lal Meena, the junior most promotee IAS officer of 2000 batch of Rajasthan cadre and above Shri Praveen Gupta, the senior most RR IAS officer of 1995 batch of Rajasthan cadre.

12.1 As per Rule 4 of the IAS (Regulation of Seniority) Rules, 1987, the officers whose names have been mentioned at SI. No. 1 of the select list of 2002 shall be placed below Shri C.M. Khatri, the junior most promotee IAS officer of 1994 batch and above Shri Praveen Gupta, the senior most RR IAS officer of 1995 batch of Rajasthan cadre.

Select List of 2003 (SCS category)

13.1 As per Rule 4 of the IAS (Regulation of Seniority) Rules, 1987, the officers whose names have been mentioned at SI. No. 1 to 2 of the select list of 2003 shall be placed below Shri Kunji Lal Meena, the junior most RR IAS officer of 1995 batch and above Shri Ajitabh Sharma, the senior most RR IAS officer of 1996 batch of Rajasthan cadre.
13.2 As per Rule 4 of the IAS (Regulation of Seniority) Rules, 1987, the officers whose names have been mentioned at SI. No. 3 of the select list of 2003 shall be placed below Shri Rajesh Kumar Yadav, the junior most RR IAS officer of 1996 batch and above Shri Hemant Kumar Gera, the senior most RR IAS officer of 1997 batch of Rajasthan cadre.
13.3 Seniority /year of allotment of officers of the select list of 2003 has been restricted under proviso to Rule 3(3) (ii) of IAS (Regulation of Seniority)Rule, 1987.
