ORDER
The Government of Uttar Pradesh had sent a proposal vide their letter no. 468/2/-1-2015-29/1(1)/2011 dated 2nd February, 2015 for fixation of seniority / assigning the year of allotment to the one officer viz. Shri Vivek Varshney appointed to IAS from State Civil Service on the basis of inclusion of his name “Unconditional and Final” in select list of the year 2013.
- In this connection, it is mentioned that seniority/year of allotment of IAS officer appointed on the basis of Select List of 2013 has already been fixed seniority vide notes and orders on page 11-13/ante. Seniority/year of allotment of Shri Vivek Varshney could not be fixed along-with other officers, as he was provisionally included in the select list of 2013 subject to clearance in the disciplinary proceedings pending against him. Subsequently inclusion of his name in the said select list was declared unconditional and final by UPSC on a proposal from State Government. Consequently Shri Vivek Varshney was appointed to IAS vide notification No. 14015/22/2014-AIS-I (A) dated 13th August, 2014.
- From the select list 2013, it has been observed that Shri Vivek Varshney at SL No. 7 included below Shri Rajeev Sharma.
- In view of the above, the seniority/year of allotment of above officer has been considered and computed under Rule 3(3) (ii) of IAS (Regulation of Seniority), Rules 1987, and other relevant Rules as amended from time to time. Weightage formula is as under:-

4.1 As per Rule 4 of the IAS (Regulation of Seniority) Rules, 1987, the officers whose names have been mentioned at Sl. No. 1 to 12 shall be placed enbloc below Shri Yogesh Kumar Shukla, junior most promotee IAS officer of 2006 batch (appointed on the basis of Select List of 2012) and above Ms. Sheetal Verma, senior most DR IAS officer of 2007 batch of UP cadre. 4.2 As per Rule 4 of the IAS (Regulation of Seniority) Rules, 1987, the officers whose names have been mentioned at Sl. No. 13 to 22 shall be placed enbloc below Shri Rajesh Kumar, junior most DR IAS officer of 2008 batch and above Ms. Subhra Saxena, senior most DR IAS officer of 2009 batch of UP cadre 4.3. The seniority /year of allotment officers at Sl. No. 1 to 3 and Sl. No. 14 to 21 has been restricted as per proviso to Rule 3(3)(ii) of the IAS (Regulation of Seniority) Rules. 1987. 5. This Department’s order of even number dated $17^{\text {th }}$ October, 2014 would stand superseded to the above extent. 6. The order may be conveyed to the concerned officer.
