Indian Administrative Service (Regulation of Seniority) Amendment Rules, 2016

The Central Government has issued the Indian Administrative Service (Regulation of Seniority) Amendment Rules, 2016, to modify the existing rules regarding the regulation of seniority within the Indian Administrative Service. These amendments clarify the calculation of weightage given for service rendered by officers, particularly concerning the equivalence to the post of Deputy Collector and the application of weightage based on years of service. NOTIFICATION

R $\qquad$ (E).- In exercise of the powers conferred by sub-section (1) of section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government, after consultation with the Governments of the States concerned, hereby makes the following rules further to amend the Indian Administrative Service (Regulation of Seniority) Rules, 1987, namely:-

  1. (1) These rules may be called the Indian Administrative Service (Regulation of Seniority) Amendment Rules, 2016.
    (2) They shall come into force on the date of their publication in the Official Gazette.
    (3) The amendment will be applicable to all the officers who have been appointed to Indian Administrative Service on the basis of the Select List(s) which has/have been prepared or shall be prepared for the appointment by selection of the Non-State Civil Service Officers as per the ratio laid down by Hon’ble Punjab and Haryana High Court and confirmed by Hon’ble Supreme Court in the matter of Praveen Kumars case and keeping in view the provisions contained in this Department’s Office Memorandum No.22012/99/2009-AIS-I dated $17^{\text {th }}$ March, 2015.
  2. In the Indian Administrative Service (Regulation of Seniority) Rules, 1987, in rule 3, in sub-rule (3), in clause (iii):-
    (A) for the words, figures and letters “equivalent to the post of Deputy Collector or a higher post, up to the $31^{\text {st }}$ December of the year “immediately before the year”, the words, figures and letters “equivalent to the post of Deputy Collector or a higher post, upto the $31^{\text {st }}$ December of the year” shall be substituted;
    (B) for sub-clauses (a) and (b) the following sub-clauses shall be substituted namely:-
    “(a) for the service rendered by him up to twelve years, he shall be given a weightage of one year for every completed four years of service, subject to a minimum of three years;(b) for the service rendered by him beyond twelve years, as referred to in subclause (a) and upto 21 years, he shall be given a weightage of one year for every completed three years;
    (c) for the service rendered by him beyond 21 years, as referred to in subclause (b), he shall be given a weightage of one year for every completed two years of service, subject to a maximum of three years.”
