ORDER
Subject: Revision of seniority/year of allotment of promotee IAS officers of Rajasthan Cadre for the Select Lists of 1994-95 to 2000- regarding
Whereas, in compliance of order dated 23.09.2016 passed by Hon’ble High Court of Rajasthan, Jaipur Bench in D.B. Civil Misc. Application No.104/2016 in DB Civil Writ Petition No. 7472/2013 S/Shrl Harish Krishhniya, H.C. Sharma, K.R. Kamlesh, Arun Kumar Ojha and Ramash Chand Jain have been notionally appointed to IAS on the basis of the Review Select List of the year 1994-95 vide this Department’s Order No.14015/19/2013-AIS-I dated 20.04.2018. 2. And whereas, consequent upon dismissal of SLP No. 4930-4931 of 2016 and Review Petition No. 001428-001429 /2017 filed by this Department in the case of FR Jamadar and other connected court cases filed by the MHA, this Department vide OM No. 14014/14/2014-AIS-I dated 21.08.2017 has decided to apply the amended seniority regulations prospectively i.e. wet 18.04.2012. Further, this Department vide OM No. 14014/14/2014-AIS-I dated 03.11.2017 has decided the seniority /year of allotment of officers appointed after 18.04.2012 against the vacancies arisen between 1.2.2010 to 18.04.2012 may be fixed as per pre-amended seniority rules throughout the cadres. Furthermore, vide OM No. 14014/14/2014-AIS-I dated 22.01.2018 this Department has also decided to count the services of the officers rendered in the rank of Deputy Collector or equivalent upto the $31^{\text {st }}$ December of the vacancy year against which officer has been appointed to IAS. 3. And therefore, in view of the above and on receipt of the proposal from the State Government of Rajasthan vide letter No.F.6(2)Pers/A-I/2012 Part dated 09.05.2018, the seniority /year of allotment of officers appointed by promotion to IAS of Rajasthan Cadre from Select Lists of 1994-95, 1996-97 to 2000 has been reviewed and re-determined by applying pre-amended Rule 3 (3)(ii) of IAS (Regulation of Seniority) Rules, 1987 read with clarification dated 21.08.2017, 03.11.2017 and 22.01.2018: 4. No. 1 to 5, 7, 9 to 15 in the Select List of 1994-95 has been restricted under provisions of the rule 3(3)(ii) of IAS (Regulation of Seniority) Rules, 1987 which provide that an officer shall not be assigned year of allotment earlier than year of allotment assigned to other officer senior to him in that Select List or appointed on the basis of earlier Select List.
5.1. As per Rule 4 of the IAS (Regulation of Seniority) Rules, 1987, officers of Select List of 1994-95 mentioned at SI. No.1 to 19 shall be placed below Shri Amar Singh Bhat, junior most promotee IAS officer of 1989 batch and above Shri Sanjay Malhotra, senior most IAS officer of 1990 batch of Rajasthan Cadre.

6.1 As per Rule 4 of the IAS (Regulation of Seniority) Rules, 1987, officers of Select List of 1996-97 mentioned at SI. No.1 to 9 shall be placed below Shri Sudhaneh Pant, only RR IAS officer of 1991 batch and above Shri Abhay Kumar, senior most RR IAS officer of 1992 batch of Rajasthan Cadre.

9.1 As per Rule 4 of the IAS (Regulation of Seniority) Rules, 1987, officers of Select List of 1999 mentioned at SI. No. 1 to 2 shall be placed Shri Rajat Kumar Mishra junior most RR IAS officer of 1992 batch and above Shri Tanmay Kumar senior most RR IAS officer of 1993 batch of Rajasthan Cadre.
9.2 As per Rule 4 of the IAS (Regulation of Seniority) Rules, 1987, officers of Select List of 1990 mentioned at SI. No. 3 to 5 shall be placed below Ms Apama Arora, junior most RR IAS officer of 1993 batch and above Shri Kuldeep Ranka, senior most RR IAS officer of 1994 batch of Rajasthan Cadre.

10.1 As per Rule 4 of the IAS (Regulation of Seniority) Rules, 1987, officer of Select List of 2000 mentioned at SI. No. 1 shall be placed below Ms. Roli Singh, junior most RR IAS officer of 1994 batch and above Shri Praveen Gupta, senior most RR IAS officer of 1995 batch of Rajasthan cadre.
- This issues with supersession of this Department’s orders of even number dated 14014/8/97-AIS-I dated 17.03.1997, 21.10.1999, 16.02.2000 and 28.12.2015.
