ORDER
Whereas, in the case of appointment by promotion from the State Civil Servi ce (SCS) of Rajasthan to the Indian Administrative Service (IAS), year wise Select Lissts from 1996-97 to 2011 were prepared by the Selection Committee in its meeting heeld on 26.12.2012.
And Whereas, the recommendations of the Selection Committee were approved by the Union Public Service Commission on 31.12.2012;
And Whereas, the select list of 1996-97 to 2011 were notified vide Government of India’s notification No. 14015/19/2012-AIS(I)-A dated 31.12.2012;
And Whereas, in compliance with order dated 02.02.2015 passed by Hon’ble Hi gh Court of Rajasthan, Jaipur Bench in DB Civil Writ Petitions No. 7472/2013, 7118/2013, 7136/2013, 9686/2013 and 20819/2013 together with order dated 04.04.2013 passed by Hon’ble Central Administrative Tribunal, Jaipur Bench in OA Nos. 810/2012 and 80/2013, the year-wise select list from 1996-1997 were reprepared after notional appointment of selected but retired state civil service officers and following the concept of dynamic determination of vacancies.
And Whereas, based upon the above criteria, the select lists of 1997 upto 2011 were re-notified vide Government of India’s Notifications No 14015/19/2013-AIS(I)-A dated 15.09.2015.
And Whereas, Consequently appointments from revised select lists of 1997 upto 2011 were also re notified vide Government of India’s Notifications No 14015/19/2013-AIS(I)-B dated 15.09.2015.
And Whereas, Subsequently certain SCS officers who were left out from being appointed to IAS from the previous select list of 1993-94 and 1994-95 filed petitions before the Hon’ble High Court of Rajasthan seeking similar benefits.
And Whereas, the Hon’ble High Court of Rajasthan, Jaipur Bench vide its order dated 23.09.2016 passed in D. B. CMA No. 104/2016 filed by Sri Ramesh Chandra Jain and others in DBCWP No. 7472/2013 (Chhaya Bhatnagar vs Uol and others), directed as under;
” we have noticed the grievance of the present applicants, but regard to the Select List of the year 1996-97 onwards under the notification dated 30.12.2012, but still the fact is that the principles laid down by this Court in extending notional appointment and consequential benefits flowing thereof, to the officers, who are placed in the review select list of 1994-95 deserve consideration, who became entitled to claim notional appointment \& consequential notional benefits on the basis of the principles laid down by this Court in its judgement dated 02.02.2015.

In the present facts and circumstances, it is expected that the principle laid down by this Court in the judgement dated 02.02.2015 deserves to be considered in the cases of the officers, who find place in the review select list/select list under notification dated 30.12.2012.
Consequently, taking note of the submissions made above, we dispose of the present miscellaneous application in the above terms.”
And Whereas, in compliance of the above directions, as a first step, notional appointment of 5 officers from the Select List of 1994-95 was notified by the Govt. of India order No. 14015/19/2013-AIS(I) dated 20.04.2018.
And Whereas, As a result of notional retirement of above officers, the vacancies for the Select Lists of 2001 upto 2006 were re-determined vide Govt. of India’s letter dated 20.04.2018.
And Whereas, Subsequently, a review selection committee meeting was conven ed by Union Public Service Commission on 04.01.2019 to Review the Select Lists of 2001 upto 2006 based upon re-determination of vacancies.
And Whereas, the recommendations of the Selection Committee that met on 04.01.2019 to review the Select Lists of 2001 upto 2006 have since been approved by the Union Public Service Commission on 01.03.2019.
And Whereas, the State Government of Rajasthan, vide their letter no. F.6(2)Pers/A- 1/2012 dated 14.03.2019 have submitted a proposal for notional appointment of 3 officers from the above Review Select Lists of 2001 upto 2006.
Now therefore; In compliance of order dated 23.09.2016 passed by Hon’ble High Court of Rajasthan, Jaipur Bench in D. B. CMA No. 104/2016 filed by Sri Ramesh Chandra Jain and others in DBCWP No. 7472/2013 (Chhaya Bhatnagar vs Uol and others),, the following officers are granted notional appointment to the Indian Administrative Service of Rajasthan Cadre from their respective Select Lists:-
