Amendment to Indian Police Service (Pay) Rules Regarding Pay Fixation for Higher Scale Appointments

Important updates have been issued concerning the pay structure for members of the Indian Police Service. These new rules clarify how an officer’s pay will be fixed when moving from a lower scale post to a higher scale post, particularly those included in Scheduled III of the service regulations. The revised guidelines stipulate that an officer’s pay in the higher scale will be set at either the minimum of that new scale or the next stage above their previous pay, whichever offers a higher amount. Significantly, any special pay attached to the previous lower scale post will not be factored into determining the new higher scale pay. However, provisions are made to protect officers by allowing the difference between their prior pay (including special pay) and the new higher scale pay to be granted as a personal allowance, which will gradually be absorbed by future pay increases. The rules also outline the process for re-fixing pay if an officer’s pay in the lower scale would have increased after their initial fixation in the higher scale. These amendments ensure a standardized and fair approach to pay progression within the service.

B O T I P I O A T I O N

GSR…….. In exercise of powers conferred by sub-section (1) of Section 3 of the All India Services Act, 1954 (61 of 1951), the Central Government, after consultation with the Governments of the States concerned, hereby makes the following rules further to amend the Indian Police Service (Pay) Rules, 1954, namely:

(1) These rules may be called the Indian Police Service (Pay) (Amendment) Rules, 1973.

(2) These rules shall come into force at the date of their publication in the official gazette.

  1. In the Indian Police Service (Pay) Rules, 1954, after rule 8, the following rule shall be inserted, namely:

“84. Pization of pay of a member of the service on appointment from one post in a lower scale to a post in a higher scale included in Scheduled III:

(1) The pay of member of the Service holding a post carrying a pay scale above the time scale of pay of the Service and specified in Schedule III shall, on his appointment to another post in the said Schedule carrying a higher scale of pay, be fixed at the minimum of that higher scale or at the stage in the higher scale next above the pay drawn by him in the lower scale, whichever is higher.

Note: 1. For the purpose of determining the higher scale of pay, special pay, if any, attached to a post will not be taken into account.

Note: 2. Posts in the Selection grade will be treated as posts in the time scale of pay of the service.

(2) Where there is an enhancement of pay in the lower scale of pay of a member of the Service referred to in sub-rule (1) as a result of increment or otherwise after his pay is fixed under that sub-rule, his pay shall be re-fixed in the higher scale from the date of such enhancement as is such a member is appointed to the post on that date in that scale.(3) While fixing the pay under sub-rule (1), the specia. pay, if any, drawn by a member of the Service in the lower scale of pay will not be taken into account, but the difference in the pay and special pay drawn by such member in the lower scale and the pay fixed in the higher scale will be allowed as personal pay to such member absorbable in future increases in pay:

Provided that it is certified that but for the appointment of the member to the post in the higher scale, he would have continued to draw the special pay in the lower scale:

Provided further that the protection of special pay under this sub-rule shall have effect only for so long as the member would have drawn the special pay if he had continued in the lower scale.”
