Indian Administrative Service (Pay) Third Amendment Rules, 2008 Notification

I

A significant update has been rolled out concerning the framework for Indian Administrative Service (IAS) officers’ remuneration and cadre management. These new directives, officially titled the Indian Administrative Service (Pay) Third Amendment Rules, 2008, introduce revisions to the established IAS (Pay) Rules of 2007. The core change revolves around the methodology for determining the count of Selection Grade posts within a State Cadre. Henceforth, these crucial positions will be allocated based on specific norms set by the Central Government, which are designed for the overall fixation of IAS cadre strength. This adjustment aims to bring greater clarity and standardization to the career progression and structural organization of IAS officers across various states. The government has affirmed that these amendments are not anticipated to negatively affect any existing member of the Indian Administrative Service.

सा.का.नि. 20(अ).—केन्द्रीय सरकार, अखिल भारतीय सेवा अधिनियम, 1951 (1951 का 61) की धारा 3 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए सम्बद्ध राज्यों से परामर्श करने के पश्चात् भारतीय प्रशासनिक सेवा (वेतन) नियम, 2007 का संशोधन करने के लिए एतदद्वारा निम्नलिखित नियम बनाती है, अर्थात् :—

  1. इन नियमों का नाम भारतीय प्रशासनिक सेवा (वेतन) तीसरा संशोधन नियम, 2008 है ।
  2. ये राजपत्र में प्रकाशन की तारीख से प्रवृत्त हुए माने जाएंगे ।
  3. भारतीय प्रशासनिक सेवा (वेतन) नियम, 2007 की अनुसूची II के भाग ख में, निम्नलिखित पैराग्राफ रखा जाएगा, अर्थात् :—

“(1) किसी राज्य संवर्ग में चयन ग्रेड में पदों की संख्या, भारतीय प्रशासनिक सेवा की संवर्ग पद संख्या के निर्धारण के लिए केन्द्रीय सरकार द्वारा जारी किए गए मानकों के अनुसार होगी ।”

टिप्पण : मूल नियम भारत के राजपत्र, असाधारण में सा.का.नि. 213(अ) दिनांक 20 मार्च, 2007 द्वारा प्रकाशित किए गए और बाद में सा.का.नि. 23(अ), दिनांक 10 जनवरी, 2007 तथा सा.का.नि. 665(अ) दिनांक 19 सितम्बर, 2008 द्वारा संशोधित किए गए ।

व्याख्यात्मक ज्ञापन

यह प्रमाणित किया जाता है कि इन नियमों को प्रभावी किए जाने से भारतीय प्रशासनिक सेवा के किसी भी सदस्य के प्रतिकूल रूप से प्रभावित होने की संभावना नहीं है ।

New Delhi, the 6th January, 2009
G.S.R. 20(E).-In exercise of the powers conferred by sub-section (1) of Section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government after consultation with the Government of the States concerned, hereby makes the following rules to amend the Indian Administrative Service (Pay) Rules, 2007, namely :-

  1. These rules may be called the Indian Administrative Service (Pay) Third Amendment Rules, 2008.
  2. They shall be deemed to have come into force from the date of their publication in the Official Gazette.
  3. In Part B of the Schedule II of the Indian Administrative Service (Pay) Rules, 2007 for paragraph 1, the following paragraph shall be substituted, namely :-
    “(1) The number of posts in the Selection Grade in a State Cadre shall be as per the norms issued by the Central Government for fixation of cadre strength of IAS.”

It is certified that no member of the Indian Administrative Service is likely to be adversely affected by giving effect to these rules.
