अधिसूचना

सा. का.नि. 624(अ)—अखिल भारतीय सेवा अधिनियम, 1951 (1951 का 61) की धारा 3 की उप-धारा (1) और 1(क) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार, भारतीय प्रशासनिक सेवा (बेतन) नियमावली, 2016 में आगे और संशोधन करने के लिए एतद्वारा निम्नलिखित नियम बनाती है, अर्थात्—

1. (1) इन नियमों की भारतीय प्रशासनिक सेवा (बेतन) संशोधन नियमावली, 2016 कहा जाएगा।
2. (2) इन्हें 1 जनवरी, 2016 से प्रभावी हुआ माना जाएगा।
3. भारतीय प्रशासनिक सेवा (बेतन) नियमावली, 2016 के नियम 5 में उप-नियम (9) के लिए निम्नलिखित उप नियम प्रतिस्थापित किए जाएंगे; अर्थात्—

“(9) सेवा में एक ग्रेड से दूसरे ग्रेड में पदोन्नति होने पर सेवा के सदस्य के पास उन्नत पद के वेतन स्तर में अपनी पदोन्नति की तिथि से या उपरोक्त संमत उप-नियम में दिए गए प्रावधान के अनुसार निचले स्केल में जिस तिथि को वह वेतन वृद्धि (इन्डीमेट) अर्जित करता है उस तिथि से अपने वेतन को नियत करवाने का विकल्प होगा; बाद के मामले में, पदोन्नति की तारीख पर सेवा के सदस्य को उस स्तर में अगले उन्नत सेल में रखा जाएगा जिसमें निचले स्केल में अगले वेतन वृद्धि की तारीख अर्थात् जुलाई की पहली तारीख या जनवरी की पहली तारीख से उपरोक्त संमत उप-नियम में दिए गए प्रावधानों के अनुसार किए जाने वाले अगले पुनः नियतन के साथ उसे पदोन्नत किया जाता है।

ब्याख्यात्मक ज्ञापन:- केंद्र सरकार ने भारतीय प्रशासनिक सेवा (वेतन) नियमावली 2016 के नियम 5 के उप-नियम 9 में संशोधन करने का निर्णय लिया है जो भा.प्र.मे के अधिकारियों के उनके एक छेट से दूसरे में पंजीकृति पर वेतन नियंत्रण का उपबंध करता है। तदनुसार भारतीय प्रशासनिक सेवा (वेतन) नियमावली 2016 को 1 जनवरी, 2016 से संशोधित किया जा रहा है।

यह प्रमाणित किया जाता है कि भारतीय प्रशासनिक सेवा का कोई सदस्य उन नियमों के जूनवक्षी प्रभाव से प्रतिकूल रूप में प्रभावित नहीं होने जा रहा है।

टिप्पणी: प्रधान नियमावली को दिनांक 8 सितम्बर, 2016 की अधिसूचना संख्या सा. का. नि. 870(ज) के माध्यम से प्रकाशित किया गया था और तत्पश्चात् दिनांक 12 जून, 2017 के अधिसूचना संख्या सा. का. नि. 575(ज) के माध्यम से संशोधित किया गया था।

NOTIFICATION

New Delhi, the 30th August, 2018

G.S.R. 824(E).—In exercise of the powers conferred by sub-sections (1) and (1A) of section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government hereby makes the following rules further to amend the Indian Administrative Service (Pay) Rules, 2016, namely:—

1. (1) These rules may be called the Indian Administrative Service (Pay) Amendment Rules, 2018.
2. (2) They shall be deemed to have come into force on the 1st day of January, 2016.

3. In the Indian Administrative Service (Pay) Rules, 2016, in rule 5, for sub-rule (9), the following sub-rule shall be substituted, namely:—

“(9) On promotion from one grade to another in the Service, a member of the Service shall have an option to get his pay fixed in the Level of the higher post either from the date of his promotion or from the date on which he subsequently earns an increment in the lower scale in the manner provided in the relevant sub-rule above; in the latter case, on the date of promotion, a member of Service shall be placed at the next higher cell in the Level to which he or she is promoted with further re-fixation to be done in the manner provided in relevant sub-rule above with effect from the 1st day of January, or 1st day of July, the date of accrual of next increment in the lower scale.”

Explanatory Memorandum:

The Central Government has decided to amend sub-rule 9 of rule 5 of the Indian Administrative Service (Pay) Rules, 2016 which provides for the fixation of pay of IAS officers on their promotion from one grade to another. The Indian Administrative Service (Pay) Rules, 2016 are being amended accordingly with effect from the 1st January, 2016.

It is certified that no member of the Indian Administrative Service is likely to be adversely affected by giving retrospective effect to these rules.

Note: The principal rules were published vide notification number G.S.R. 870(E), dated 8 September, 2016 and were subsequently amended vide notification number G.S.R. 575(E), dated 12 June, 2017.
