नई दिल्ली, 13 मई, 1998
(ग) का. नि. 248 (अ).— राष्ट्रपति, संविधान के अनुच्छेद 309 के परशुरू और अनुच्छेद 148 के खण्ड (5) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और भारतीय लेखा परीक्षा और लेखा विभाग में रीवांश व्यक्तियों के संबंध में भारत के निर्वाचक महालेखापरीक्षक से परामर्श करने के पश्चात्, मूल नियम का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् :
(1) इन नियमों का संक्षिप्त नाम मूल (संशोधन) नियम 1998 है।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।
(ग) मूल नियम के नियम 56 में,—
(ग) खण्ड (क) के स्थान पर निम्नलिखित खंड रखा जाएगा, अर्थात्,—
(क) इस नियम में जैसा अन्यथा उपबंधित है उसके विपरीत, प्रत्येक सरकारी सेवक, उस मास के, जिसमें वह सात वर्ष की आयु प्राप्त करता है, अन्तिम दिन के अपराह्न में सेवा से निवृत्त होगा।
परन्तु ऐसा सरकारी सेवक, जिसकी जन्म की तारीख मास की पहली तारीख है, सात वर्ष की आयु प्राप्त कर लेने पर पूर्ववर्ती मास के अंतिम दिन के अपराह्न में सेवा से निवृत्त होगा।
(ख) खंड (ग) और खंड (गग) का लोप किया जाएगा।
(ग) खंड (ग) के स्थान पर निम्नलिखित खंड रखा जाएगा, अर्थात्,—
(ग) किसी भी सरकारी सेवक का रीवाकाल सात वर्ष की रीवानिवृत्ति की आयु से अधिक नहीं बढ़ाया जाएगा।
परन्तु किसी ऐसे सरकारी सेवक का, जो बजट करने से चिन्ता दे या किसी ऐसी समिति के पूर्णकालिक सदस्य के रूप में कार्यरत है जिसका कार्यकाल में परिस्थापन किया जाना है, रीवाकाल लोकहित में तीन मास से अनधिक की अवधि के लिए बढ़ाया जा सकेगा।
परन्तु यह और कि चिकित्सीय और वैज्ञानिक क्षेत्रों में किसी विशेषज्ञ का रीवाकाल ब्याज वर्ष की आयु तक उस दिशा में बढ़ाया जा सकेगा यदि

इस सेवाकाल बढ़ाया जाना लोकहित में हो और ऐसे सेवाकाल बढ़ाए जाने के अभाव को लेखबद्ध किया गया हो :
“इसके लिए भी कि समुचित प्राधिकारी को किसी स्थायी या स्थायित्व सम्बन्धी सेवाकाल की दिशा में तीन मास से अनुपात की या किसी अस्थायी सरकारी सेवाकाल की दिशा में एक मास की लिखित सूचना देकर या ऐसी सूचना के अभाव में तीन मास की लिखित सूचना देकर या ऐसे सेवाकाल की अभाव के पूर्व समाप्त करने का अधिकार होगा।”
- (५) खंड (ङ), खंड (छ) और खंड (ल) का लाभ किया जाएगा,
- (ङ) खंड (झ) के स्थान पर निम्नलिखित खंड रखा जाएगा, अर्थात् :
- “किसी सिविल विभाग में का कोई सैनिक अधिकारी खाते वर्च को आयु प्राप्त कर लेने की तारीख को रिपोर्टरेटिव के नोट पर जाएगा।”।

NOTIFICATION
New Delhi, the 13th May, 1998
G.S.R. 248 (E). – In exercise of the powers conferred by the proviso to article 309 and Clause (5) of article 148 of the constitution and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian state and Account Department, the President hereby makes the following rules, namely :
- These Rules may be called the Fundamental (Amendment) Rules, 1998.
- They shall come into force from the date of their publication in the Official Gazette.
- In the Fundamental Rules, in Rule 56,
- (a) For clause (a), the following clause shall be substituted, namely:
- “(a) Except as otherwise provided in this rule, every Government Servant shall retire from service on the afternoon of the last day of the month in which he attains the age of sixty years;
- “Provided that a Government Servant who shall retire from service on the afternoon of the last day of the preceding month on attaining the age of sixty years.”
- (b) Clause (c) and (cc) shall be omitted;
- (d) For clause (d), the following clause shall be substituted, namely:
- “(d) No Government Servant shall be granted extension of service beyond the age of retirement of sixty years.”
- (a) For clause (a), the following clause shall be substituted, namely:
Provided that a Government Servant dealing with budget work or working as a full-time member of a Committee shall be bound up within a short period of time may be granted extension of service for a period not exceeding three months in public interest.
Provided further that a specialist in medical or scientific fields may be granted extension of service up to the age of twenty years if such extension is in public interest and the grounds for such extension are recorded in writing.
Provided also that the appropriate authority shall have the right to terminate the extension of service before the expiry date of the date of such extension by giving a notice in writing of the date of the date of such extension to the case of a permanent or a quasi-permanent Government Servant, or, of one month in the case of a temporary Government Servant, or, pay and allowance in lieu of such notice.
(d) Clause (e), (g) and (h) shall be omitted;
(e) For clause (i), the following clause shall be substituted, namely:
– “(i) A military officer in a Civil Department shall cease to be in civil employment on the date he attains the age of sixty years.”
