New Delhi, the 21st May, 1999
G.S.R. 382(E).-In exercise of the powers conferred by the proviso to article 309 and clause (5) of the article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to the persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules regulating the consultation with Union Public Service Commission in regard to Central Civil Services and Civil Posts under the Union, namely:-

1. Short title and commencement :-

  1. (1) These rules may be called the Central Civil Services and Civil Post (Consultation with Union Public Service Commission) Rules, 1999.
    (2) They shall come into force on the 1st day of June, 1999.

2. Application :

These rules shall apply to all Central Civil Services and Civil posts under the Union.

3. Recruitment to Group “B” Posts :

It shall not be necessary to consult the Union Public Service Commission while making direct recruitment to any Group ‘B’ service or post which is in the scale of pay the maximum of which is below Rs. 10500.

4. Confirmation :

It shall not be necessary to consult the Union Public Service Commission while making substantive appointment or confimation to any Group ‘ $A$ ‘ or Group ‘ $B$ ‘ service or post, of any person recruited directly through the Union Public Service Commission to such Group ‘ $A$ ‘ or Group ‘ $B$ ‘ service or post.

5. Promotion by Selection-cum-seniority :

It shall not be necessary to associate the Union Public Service Commission while making promotion to any Group ‘ $A$ ‘ service or post the maximum of the scale of pay of which is less than Rs. 16500, of an officer holding any Group ‘ $A$ ‘ service or post.

6. Amendment to recruitment and other service rules :

All recruitment rules or other service rules containing provision for consultation or association of the Union Public Commission in respect of recruitment, promotion or confirmation of persons to the Central Civil Services and Civil Posts under the Union including those in the Indian Audit and Accounts Department shall stand amended to the extent provided for in rules 3 to 5 (both inclusive).

7. Interpretation :

If any question arises as to the interpretation of these rules, the same shall be decided by the Central Government.

NOTIFICATION

New Delhi, the 21st May, 1999 G.S.R. 383 (E).-In exercise of the powers conferred by the proviso to clause (3) of article 320 of the Constitution, the President hereby makes the following regulations further to amend the Union Public Service Commission (Exemption from Consultation) Regulations, 1958, namely :-

  1. (1) These regulations may be called the Union Public Service Commission (Exemption from Consultation) Amendment Regulation, 1999. (2) They shall come into force on the 1st day of June, 1999.
  2. In schedule II to the Union Public Service Commission (Exemption from Consultation) Regulations, 1958, the existing entry shall be numbered as serial number 1 and after serial number 1 as so numbered and the entry relating thereto, the following serial number and entry shall be added, namely :- “2. Direct recruitment to all Group ‘B’ posts in the various Ministries/Departments of the Government of India and their attached and subordinate offices and which are in the scale of pay the maximum of which is below Rs. 10,500.” [No. 39018/1/98-Estt.
