सा.का.नि. 8.-संविधान के अनुच्छेद 148 के उपखंड (5) के साथ पटित अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारतीय लेखा परीक्षा तथा लेखा विभाग में सेवारत व्यक्तियों के संबंध में भारत के नियंत्रक और महालेखा परीक्षक से परामर्श के बाद केन्द्रीय सिविल सेवा (आचरण) नियमावली, 1964 में आगे और संशोधन करने के लिए राष्ट्रपति एतद्द्वारा निम्नलिखित नियम बनाते हैं, अर्थात् :-

1. (1) इन नियमों को केन्द्रीय सिविल सेवा (आचरण) संशोधन नियमावली, 2008 कहा जाए ।
   (2) ये शासकीय राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. केन्द्रीय सिविल सेवा (आचरण) नियमावली, 1964 में नियम 16 में, उप-नियम (2) को उपनियम 2(i) के रूप में पुन: क्रमांकित किया जाएगा और इस तरह से पुन: क्रमांकित किए गए उस उप-नियम के बाद निम्नलिखित खण्ड शामिल किया जाएगा, अर्थात्:-
   “(2) (ii) ऐसा कोई भी सरकारी कर्मचारी, जो केन्द्रीय सार्वजनिक क्षेत्र के किसी उद्यम के शेयरों को किसी प्रारंभिक सार्वजनिक ऑफरिंग अथवा अनुवर्ती सार्वजनिक ऑफरिंग के मूल्य के निर्धारण की निर्णयकारी प्रक्रिया में शामिल हो, सार्वजनिक क्षेत्र के ऐसे उद्यम की प्रारंभिक सार्वजनिक ऑफरिंग अथवा अनुवर्ती सार्वजनिक ऑफरिंग में शेयरों के आवंटन हेतु या तो अपने आप अथवा अपने परिवार के किसी अन्य सदस्य के माध्यम से अथवा उसकी ओर से कार्य कर रहे किसी अन्य व्यक्ति के माध्यम से आवेदन नहीं करेगा।”

NOTIFICATION

New Delhi, the 27th January, 2009
G.S.R. 8.-In exercise of the powers conferred by the proviso to article 309 read with clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Conduct) Rules, 1964, namely :-1. (1) These rules may be called the Central Civil Services (Conduct) Amendment Rules, 2008.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Civil Services (Conduct) Rules, 1964, in rule 16, sub-rule (2) shall be re-numbered as sub-rule (2) (i) thereof, and after that sub-rule as so re-numbered, the following clause shall be inserted, namely :-
“(2) (ii) No Government servant who is involved in the decision making process of fixation of price of an Initial Public Offering or Follow-up Public Offering of shares of a Central Public Sector Enterprise shall apply, either himself or through any member of his family or through any other person acting on his behalf, for allotment of shares in the Initial Public Offerings or Follow-up Public Offerings of such Central Public Sector Enterprise”.
