सा.का.नि. 160.—राष्ट्रपति, संविधान के अनुच्छेद 148 के खण्ड (5) के साथ पंडित अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा भारतीय लेखापरीक्षा और लेखा विभाग में कार्यरत व्यक्तियों के संबंध में भारत के नियंत्रक और महालेखापरीक्षक से परामर्श के उपरांत, केन्द्रीय सिविल सेवा (छुट्टी) नियमावली, 1972 में संशोधन करने के लिए एतद्द्वारा निम्नलिखित अगले नियम बनाती है, अर्थात् :-
- (1) ये नियम केन्द्रीय सिविल सेवा (छुट्टी) (संशोधन) नियमावली, 2011 कहलाएंगे।
(2) ये नियम सरकारी राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे । - केन्द्रीय सिविल सेवा (छुट्टी) नियमावली, 1972 में, (इसके आगे उक्त नियमावली में यथा संदर्भित), नियम 27 में, उप-नियम (2) में, खण्ड (ख) के लिए, निम्नलिखित खण्डों को प्रतिस्थापित किया जाए, अर्थात् :-
“(ख) जब कोई सरकारी कर्मचारी सेवा से निष्कासित अथवा पदच्युत किया जाता है, अर्जित छुट्टी का क्रेडिट उस कलैण्डर माह जिसमें उसे सेवा से निष्कासित अथवा पदच्युत किया जाता है, के पूर्ववर्ती कलैण्डर माह में उस कलैण्डर माह के अंत तक $21 / 2$ दिन प्रति पूर्ण कलैण्डर माह की दर से अनुमत होगा;
(ग) जब कोई सरकारी कर्मचारी सेवा में रहते हुए मृत्यु को प्राप्त होता है, अर्जित छुट्टी का क्रेडिट सरकारी कर्मचारी की मृत्यु की तिथि तक सेवा के $21 / 2$ दिन प्रति पूर्ण माह की दर से अनुमत होगा।” - उक्त नियमावली में, नियम 29 में, उप-नियम (2) में, खण्ड (ग) हेतु, निम्नलिखित खण्डों को प्रतिस्थापित किया जाएगा, अर्थात् :-
“(ग) जब कोई सरकारी कर्मचारी सेवा से निष्कासित अथवा पदच्युत किया जाता है, अर्द्ध चेतन छुट्टी का क्रेडिट उस कलैण्डर माह जिसमें उसे सेवा से निष्कासित अथवा पदच्युत किया जाता है, के पूर्ववर्ती कलैण्डर माह में कलैण्डर माह के अंत तक $5 / 3$ दिन प्रति पूर्ण कलैण्डर माह की दर से अनुमत होगा;
(गक) जब कोई सरकारी कर्मचारी सेवा में रहते हुए मृत्यु को प्राप्त होता है, अर्द्ध चेतन छुट्टी का क्रेडिट सरकारी कर्मचारी की मृत्यु की तिथि तक सेवा के $5 / 3$ दिन प्रति पूर्ण माह की दर से अनुमत होगा।”

New Delhi, the 12th May, 2011
G.S.R. 160.-In exercise of the powers conferred by the proviso to article 309 read with clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Leave) Rules, 1972, namely :-
1955 PPG\&P/111. (1) These rules may be called the Central Civil Services (Leave) (Amendment) Rules, 2011.
(2) They shall come into force on the date of their publication in the Official Gazette.
- In the Central Civil Services (Leave) Rules, 1972, (hereinafter referred to as the said rules), in rule 27, in sub-rule (2), for clause (b), the following clauses may be substituted, namely:
“(b) When a Government Servant is removed or dismissed from service, credit of earned leave shall be allowed at the rate of 2½ days per completed calendar month up to the end of the calendar month preceding the calendar month in which he is removed or dismissed from Service;
(c) When a Government Servant dies while in service, credit of earned leave shall be allowed at the rate of 2½ days per completed month of service up to the date of death of the Government Servant.”
- In the said rules, in rule 29, in sub-rule (2), for clause (c), the following clauses shall be substituted, namely:
“(c) When a Government Servant is removed or dismissed from service, credit of half pay leave shall be allowed at the rate of 5/3 days per completed calendar month up to the end of the calendar month preceding the calendar month in which he is removed or dismissed from service;
(ca) When a Government Servant dies while in service, credit of half pay leave shall be allowed at the rate of 5/3 days per completed month of service up to the date of death of the Government Servant.”
