Central Civil Services (Classification, Control and Appeal) Amendment Rules, 1978

C

This notification introduces amendments to the Central Civil Services (Classification, Control and Appeal) Rules, 1965. These amendments, named the Central Civil Services (Classification, Control and Appeal) Amendment Rules, 1978, will come into effect upon their publication in the Official Gazette. Specifically, rule 15(4) of the existing rules is substituted. The revised rule states that if a disciplinary authority, based on its findings and evidence, believes a penalty specified in rule 11 (clauses v to ix) should be imposed on a government servant, it can issue an order to that effect without necessarily providing the servant an opportunity to make a representation against the proposed penalty. However, in cases where consultation with the Commission is required, the inquiry record must be forwarded to the Commission for advice, and this advice must be considered before imposing any penalty.
