Amendment to Central Civil Services Classification, Control and Appeal Rules regarding suspension review

सा. का. नि. 2.-राष्ट्रपति एतद्द्वारा संविधान के अनुच्छेद 148 के खंड (5) तथा अनुच्छेद 309 के परन्तुक द्वारा प्रदत शक्तियों का प्रयोग करते हुए तथा भारतीय लेखा तथा लेखापरीक्षा विभाग में कार्यरत व्यक्तियों के संबंध में भारत के नियंत्रक तथा महालेखापरीक्षक के परामर्श से केन्द्रीय सिकित सेवा (वर्गीकरण, नियंत्रण और अपील) नियमावली, 1965 में आगे और संशोधन करते हुए निम्नलिखित नियम बनाते हैं, अर्थात् :-

1. (1) इन नियमों का नाम केन्द्रीय सिकित सेवा (वर्गीकरण, नियंत्रण और अपील) संशोधन नियमावली, 2003 है।
   (2) ये सरकारी राजपत्र में प्रकाशन की तारीख से नब्बे दिन पश्चात् प्रवृत्त होंगे।
2. केन्द्रीय सिकित सेवा (वर्गीकरण, नियंत्रण और अपील) नियमावली, 1965 में नियम 10 में उप नियम 5 के पश्चात् निम्नलिखित उप नियम अंतःस्थापित किए जाएंगे, अर्थात् :-
   ” (6) इस नियम के अंतर्गत किए गए अथवा किया हुआ समझे गए निलंबन के किसी आदेश की समीक्षा, इस आशय के लिए गठित समीक्षा-समिति की सिफ़ारिश पर निलंबन के आदेश की तारीख के नब्बे दिन के भीतर, निलंबन में संशोधन अथवा इसे रद्द करने वाले सक्षम प्राधिकारी द्वारा की जाएगी और निलंबन की अवधि को आगे बढ़ाने अथवा इसे रद्द किए जाने के आदेश जारी करेगा। बाद की समीक्षाएँ, निलंबन की बढ़ाई गई-अवधि के समाप्त होने से पूर्व की जाएंगी। निलंबन की बढ़ाई जाने वाली अवधि एक समय में 180 दिन से अधिक नहीं होगी।
   (7) उप नियम 5 में निहित किसी बात के होने के बावजूद भी, इस नियम के उप नियम (1) अथवा (2) के अंतर्गत किया गया अथवा किया हुआ समझा गया निलंबन का कोई आदेश 90 दिन की अवधि के पश्चात् वैध नहीं होगा जब तक कि 90 दिन की समाप्ति से पूर्व, निलंबन की अवधि, समीक्षा किए जाने के पश्चात् आगे और बढ़ा नहीं दी जाए।”

G.S.R. 2.-In exercise of the powers conferred by the proviso to Article 309 and clause (5) of Article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Classification, Control and Appenl) Rules, 1955, namely:-
I. (1) These rules may be called the Central Civil Services (Classification, Control and Appenl) Amendment Rules, 2003.
(2) They shall come into force on expiry of 90 days from the date of their publication in the Official Gazette.
2. In the Central Civil Services Classification, Control and Appenl Rules, 1965, in rule 10, after sub-rule 5(e), the following sub-rules shall be added, namely:-
“(6) An order of suspension made or deemed to have been made under this rule shall be reviewed by the authority which is competent to modify or revoke the suspension, before expiry of 90 days from the date of order of suspension on the recommendation of the Review Committee constituted for the purpose and pass orders either extending or revoking the suspension. Subsequent reviews shall be made before expiry of the extended period of suspension. Extension of suspension shall not be for a period exceeding 180 days at a time.
(7) Notwithstanding anything contained in sub-rule 5(a), an order of suspension made or deemed to have been made under sub-rules (1) of (2) of this rule shall not be valid after a period of 90 days unless it is extended after review, for a further period before the expiry of 90 days.”
