The Government of India has issued amendments to the Central Civil Services (Conduct) Rules, 1964, effective from their publication in the Official Gazette. These amendments include changes to Rule 4, which now prohibits government servants from using their position to secure employment for family members in any company or firm, and clarifies that ‘private undertaking’ and ‘undertaking’ should be read as ‘company or firm’. Additionally, Rule 13 has been updated to refine wording related to accepting gifts exceeding certain monetary values for different classes of government servants. A new rule, 13A, has been inserted, explicitly prohibiting government servants from giving, taking, or abetting dowry, or demanding dowry from the parents or guardians of a bride or bridegroom, with ‘dowry’ defined according to the Dowry Prohibition Act, 1961.

NOTIFICATION
S.O. In exercise of the powers conferred by the proviso to article 309, and clause (5) of article 148 of the Constitution, and after consultation with the Comptroller & Auditor General in relation to persons serving in the Indian Audit & Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Conduct) Rules, 1964, namely:
- (1) These rules may be called the Central Civil Services (Conduct) Amendment Rules, 1976.
(2) They shall come into force on the date of their publication in the Official Gazette.
- In rule 4 of the Central Civil Services (Conduct) Rules, 1964 (hereinafter referred to as the said rules) –
(i) for sub-rule (1), the following sub-rule shall be substituted, namely:
"(1) No Government servant shall use his position or influence directly or indirectly to secure employment for any member of his family in any company or firm;(ii) in sub-rule (2), for the words ‘private undertaking’ and ‘undertaking’, wherever they occur, the words ‘company or firm’ shall be substituted; and
(iii) in sub-rule (3), for the word ‘undertaking’ wherever it occurs, the words ‘company or firm’ shall be substituted.

In rule 13 of the said rules, –
(i) in sub-rule (1), for the words ‘any person acting on his behalf’, the words ‘any other person acting on his behalf’ shall be substituted;
(ii) for sub-rule (4), the following sub-rule shall be substituted, namely:
"(4) in any other case, a government servant shall not accept, or permit any member of his family-2-
or any other person acting on his behalf to accept, any gift without the sanction of the Government, if the value thereof exceeds –
(i) Rs.75.00, in the case of a Government servant holding any Class I or Class II post; and
(ii) Rs.25.00, in the case of a Government servant holding any Class III or Class IV post.
After rule 13 of the said rules, the following rule shall be inserted, namely :-
’13A. No government servant shall –
(i) give or take or abet the giving or taking of dowry; or
(ii) demand, directly or indirectly, from the parents or guardian of a bride or bridegroom, as the case may be, any dowry.
Explanation: For the purposes of this rule, ‘dowry’ has the same meaning as in the Dowry Prohibition Act, 1961 (28 of 1961).
