The Central Secretariat Service (Amendment) Rules, 2010 have been notified to amend the Central Secretariat Service Rules, 2009. The key change introduced is the revision of Rule 19, which deals with inter-cadre transfers. The Department of Personnel and Training is now designated as the competent authority to transfer a cadre officer from one cadre-unit to another. Crucially, the concerned cadre unit must relieve the officer within forty-five days of receiving the transfer order, or a further period if sanctioned by the Department of Personnel and Training. If an officer is not relieved within this stipulated period, they will be deemed relieved and will not be entitled to draw any salary or allowances from their original cadre unit for the period of such an extension.

सा.का.नि. 759(अ).—राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सचिवालय सेवा नियम, 2009 का संशोधन करने के लिए, निम्नलिखित नियम बनाती है, अर्थात् :-
- संक्षिप्त नाम और प्ररंभ-(1) इन नियमों का संक्षिप्त नाम केन्द्रीय सचिवालय सेवा (संशोधन) नियम, 2010 है । (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
- केन्द्रीय सचिवालय सेवा नियम, 2009 के नियम 19 के स्थान पर, निम्नलिखित नियम रखा जाएगा, अर्थात् :-
“19. अंत: संवर्ग स्थानान्तरण-(1) कामिक और प्रशिक्षण विभाग, एक संवर्ग इकाई से किसी श्रेणी के किसी संवर्ग अधिकारी को अन्य संवर्ग इकाई में स्थानान्तरण करने के लिए सक्षम प्राधिकारी होगा और संबंधित संवर्ग इकाई का यह कर्तव्य होगा कि वह संबंधित अधिकारी को स्थानान्तरण आदेश की प्राप्ति के पैंतालीस दिन के भीतर या ऐसी अतिरिक्त अवधि के भीतर, यदि कोई हो, जो कामिक और प्रशिक्षण विभाग द्वारा लेखबद्ध किए जाने वाले कारणों से अनुज्ञात की जाए, भारोन्मुक्त कर दें ।
(2) यदि कोई अधिकारी उप-नियम (1) में यथानिर्दिष्ट पैंतालीस दिन के भीतर या ऐसी अतिरिक्त अवधि के भीतर भारोन्मुक्त नहीं किया जाता है, तो उस अधिकारी के बारे में यह समझा जाएगा कि वह उस संवर्ग इकाई द्वारा, जिसमें वह कार्यरत है, भारोन्मुक्त कर दिया गया है और तत्पश्चात् वह अधिकारी उस संवर्ग इकाई से, जहां से संवर्ग अधिकारी का स्थानान्तरण हुआ था, ऐसी अधिक रूकने की अवधि के लिए कोई वेतन और भत्ते प्राप्त करने का हकदार नहीं होगा ।”

NOTIFICATION
New Delhi, the 15th September, 2010
G.S.R. 759(E).—In exercise of the powers conferred by the proviso to Article 309 of the Constitution, the President hereby makes the following rules to amend the Central Secretariat Service Rules, 2009, namely:
- Short title and commencement.—(1) These rules may be called the Central Secretariat Service (Amendment) Rules, 2010.
(2) They shall come into force on the date of their publication in the Official Gazette.
- For rule 19 of the Central Secretariat Service Rules, 2009, the following rule shall be substituted, namely:
“19. Inter-cadre transfers.—(1) The Department of Personnel and Training shall be the competent authority to transfer a cadre officer of any Grade from one cadre-unit to another cadre-unit and it shall be the duty of the concerned cadre unit to relieve the officer concerned within forty-five days on receipt of the transfer order or such further period, if any, allowed by the Department of Personnel and Training, for reasons to be recorded in writing.
(2) If an officer is not relieved within forty-five days or such further period as referred to in sub-rule (1), the officer shall be ‘deemed’ to have been relieved by the cadre-unit in which he is working and thereafter the officer shall not be entitled to draw any salary and allowances for the period of such overstay from the cadre-unit from where the cadre officer was transferred.”
