मह प्रयोग करते हुए केन्द्रीय प्रशासनिक धधिकरण (प्रकिया) नियमावली, 1987 में और यागी संशोधन के लिए निम्नलिखित नियम बनाती है, धर्मात् :-

1. (1) इन नियमों का नाम केन्द्रीय प्रशासनिक धधिकरण (प्रकिया) द्वितीय

संशोधन नियमावली, 1994 है।
(2) ये सरकारी राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे।

(1)

1. केन्द्रीय प्रशासनिक अधिकरण (प्रक्रिया) नियमावली, 1987 में
   (क) नियम 3 को उप-नियम (1) के रूप में नई संस्था दी जाएगी धत:
   (ख) नई संस्था उप-नियम (1) के दूसरे परन्तुक में
   (i) खंड (क) में इस भाग को “तथापि अंतिम आदेश अंग्रेजी में होंगे” विलोपित कर दिया जाए ।
   (ii) खंड (ख) के पल्वात् निम्नलिखित खंड को शामिल किया जाए अर्थात् :-
   “(ग) राजभाषा (संघ के सरकारी प्रयोजनों के लिए) नियमावली, 1976 के नियम 2 के खंड (इ) में यथा परिभाषित खेत “क” में स्थित न्यायपीठें हिन्दी धधवा अंग्रेजी में अंतिम आदेश दे सकती है।”
   (ग) नई संस्था उप-नियम (1) के बाद निम्नलिखित उप-नियम शामिल किया जाएगा, अर्थात्:-
   “(2) उप-नियम (1) में किसी भी बात के रहते हुए, जहाँ अंतिम आदेश हिन्दी में जारी किए जाते हैं, उसका प्रमाणित अंग्रेजी धनुवाद भी साथ-साथ तैयार किया जाएगा और उसे रिकार्ड में रखा जाएगा।

पाद टिप्पण :-मूल नियम दिनांक 6-1-1987 के भारत के राजपत्र सा. का.नि. सं. -17 (ई) में प्रकाशित किए गए और तदन्तर निम्नलिखित द्वारा संशोधित किए गए :-

MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS (Department of Personnel and Training) NOTIFICATION

New Delhi, the 18th October, 1994
G.S.R. 756(E).-In exercise of the powers conferred by sub-section (1) read with clauses (d), (e) and (f) of sub-section (2) of section 35 and clause (c) of section 36 of the Administrative Tribunals Act, 1985 (13 of 1985), the Central Government hereby makes the following rules further to amend the Central Administrative Tribunal (Procedure) Rules, 1987, namely :-

1. (1) These rules may be called the Central Administrative Tribunal (Procedure) Second Amendment Rules, 1944.
   (2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Administrative Tribunal (Procedure) Rules, 1987, –
   (a) rule 3 shall be re-numbered as sub-rule (1) thereof;
   (b) in sub-rule (1) as so re-numbered, in the second proviso, –
   (i) in clause (a), the portion “However, the final order shall be in English” shall be omitted;
   (ii) after clause (b), the following clause shall be inserted, namely :-
   “(c) the Benches located in “Region A” as defined in clause (f) of rule 2 of the Official Languages (Use for Officials purposes of the Union) Rules, 1976 may, in their discretion, make final orders either in Hindi or in English.”
   (c) after sub-rule (1) as so re-numbered, the following sub-rule shall be inserted, namely :-
   “(2) Notwithstanding anything contained in sub-rule (1), where a final order is made in Hindi, an authenticated English translation thereof shall simultaneously be prepared and kept on record.”
