सा.का.नि. 71(अ).—प्रशासनिक अधिकरण अधिनियम, 1985 (1985 का 13) को धारा 4 की उप धारा (2) के अधीन केन्द्रीय सरकार को प्रदत्त शक्तियों का प्रयोग करते हुए, और तमिलनाडु सरकार से इस संबंध में अनुरोध के प्राप्त होने पर, भारत के राजपत्र, असाधारण, भाग II, खंड 3, उप-खंड (i) में प्रकाशित अधिसूचना संख्या 1254 (अ), तारीख 5 दिसम्बर, 1986 द्वारा तमिलनाडु प्रशासनिक अधिकरण को 5 दिसम्बर, 1986 से स्थापित किया गया था;

और तमिलनाडु सरकार ने, मद्रास उच्च न्यायालय के अनुमोदन से, तमिलनाडु प्रशासनिक अधिकरण को समाप्त करने के लिए आवश्यक अधिसूचना जारी करने के लिए प्रस्ताव भेजा था;

और मद्रास उच्च न्यायालय ने 2005 की रिट नाचिका संख्या 1724, 2516, 2517 और 5833 में तारीख 25 अप्रैल, 2005 के अपने सामान्य आदेश द्वारा केन्द्रीय सरकार को किसी अन्य औपचारिकता की प्रतीक्षा किए बिना अधिकरण को समाप्त करने वाली अधिसूचना जारी करने का निर्देश दिया था;

और उच्च न्यायालय ने उक्त आदेश के विरुद्ध विशेष इजाजत याचिका ग्रहण करते हुए उसके प्रवर्तन के संबंध में रोक मंजूर करने से इंकार कर दिया है।

अत: अधिसूचना के आदेश के अनुपालन में तमिलनाडु प्रशासनिक अधिकरण को तुरंत प्रभाव से समाप्त किया जाता है और तमिलनाडु राज्य प्रशासनिक अधिकरण में लंबित सभी मामलों और अभिलेखों को इस अधिसूचना के प्रकाशन की तारीख से दो सप्ताह के भीतर मद्रास उच्च न्यायालय को भेजे जाने का निर्देश दिया जाता है।

New Delhi, the 17th February, 2006

G.S.R. 71(E).—Whereas in exercise of powers conferred upon the Central Government under Sub-section (2) of Section 4 of the Administrative Tribunals Act, 1985 (13 of 1985) and on receipt of a request from Government of Tamil Nadu in this regard, the Tamil Nadu Administrative Tribunal was set up with effect from the 5th December, 1986 vide Notification No. 1254(E) dated the 5th December, 1986 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i);

And whereas Government of Tamil Nadu had sent a proposal for abolition of Tamil Nadu Administrative Tribunal with the approval of the High Court of Judicature at Madras for issuing necessary notification;

And whereas the High Court of Judicature at Madras had vide their common order dated the 25th April, 2005 in WP Nos. 1724, 2516, 2517 and 5833 of 2005 directed the Central Government to issue Notification abolishing the Tribunal without waiting for any other formality;

And whereas the Supreme Court while admitting a Special leave Petition against the said order has declined to grant a stay on the operation thereof.

Now, therefore, in compliance with the orders of the High Court of Judicature at Madras, the Tamil Nadu Administrative Tribunal is hereby abolished with immediate effect and all the pending cases and records in the Tamil Nadu State Administrative Tribunal are directed to be sent to the High Court of Judicature at Madras within two weeks from the date of publication of this Notification.
