सा.का.नि. 822(अ).— केन्द्रीय सरकार, प्रशासनिक अधिकरण अधिनियम, 1985 (1985 का 13) की धारा 35 की उपधारा (2) के खंड (ग) के साथ पठित उप-धारा (1) और धारा 36-के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय प्रशासनिक अधिकरण (अध्यक्ष, उपाध्यक्ष और सदस्यों का वेतन और भत्ते तथा सेवा की शर्तें) नियम, 1985 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-

1. (1) इन नियमों का संक्षिम नाम केन्द्रीय प्रशासनिक अधिकरण (अध्यक्ष, उपाध्यक्ष और सदस्यों का वेतन और भत्ते तथा सेवा की शर्तें) संशोधन नियम, 2018 है।
   (2) ये नियम केन्द्रीय प्रशासनिक अधिकरण के 19 फरवरी, 2007 से पहले नियुक्त अध्यक्ष, उपाध्यक्ष और सदस्यों को लागू होंगे।
2. केन्द्रीय प्रशासनिक अधिकरण (अध्यक्ष, उपाध्यक्ष और सदस्यों का वेतन और भत्ते तथा सेवा की शर्तें) नियम, 1985 के नियम 8 के उप-नियम (2) में “चौदह हजार पांच सौ बत्तीस रूपए प्रतिवर्ष” शब्दों के स्थान पर “चालीस हजार आठ सौ छत्तीस रुपए प्रतिवर्ष” शब्द रखे जाएंगे और 1 जनवरी, 2016 से इसको प्रतिस्थापित हुआ माना जाएगा।

स्पष्टीकारक ज्ञापन

केन्द्रीय सरकार ने, केन्द्रीय सरकार के कर्मचारियों की पेंशन के संबंध में सातवें वेतन आयोग की सिफारिशों को कार्यान्वित करने की दृष्टि से, ऐसे अध्यक्ष, उपाध्यक्ष और सदस्यों की, जिन्हें 19 फरवरी, 2007 से पहले नियुक्त किया गया था, की पेंशन का 1 जनवरी, 2016 से पुनरीक्षण करने का विनिध्यय किया है। तदनुसार, केन्द्रीय प्रशासनिक अधिकरण (अध्यक्ष, उपाध्यक्ष और सदस्यों का वेतन और भत्ते तथा सेवा की शर्तें) नियम, 1985 का 1 जनवरी, 2016 से भूतलक्षी रूप से संशोधन किया जा रहा है।
2. प्रमाणित किया जाता है कि केन्द्रीय प्रशासनिक अधिकरण के किसी अध्यक्ष, उपाध्यक्ष और सदस्य पर प्रस्तावित संशोधन को भूतलक्षी रूप से प्रभावी करने से प्रतिकूल प्रभाव पड़ने की संभावना नहीं है।

NOTIFICATION

G.S.R 822(E).-In exercise of the powers conferred by sub-section (1) read with clause (c) of sub-section (2) of section 35 and section 36A of the Administrative Tribunals Act, 1985 (13 of 1985), the Central Government hereby makes the following rules further to amend the Central Administrative Tribunal (Salaries and Allowances and Conditions of Service of Chairman, Vice-Chairmen and Members) Rules, 1985, namely :-

1. (1) These rules may be called the Central Administrative Tribunal (Salaries and Allowances and Conditions of Service of Chairman, Vice-Chairmen and Members) Amendment Rules, 2018.
   (2) These rules shall be applicable to the Chairman, Vice-Chairmen and Members of the Central Administrative Tribunal appointed before the 19th February, 2007.

1. In rule 8 of the Central Administrative Tribunal (Salaries and Allowances and Conditions of Service of Chairman, Vice-Chairmen and Members) Rules, 1985, in sub-rule (2), for the words “rupees fourteen thousand five hundred and thirty two per annum”, the words “rupees forty thousand eight hundred and thirty six per annum” shall be substituted and shall be deemed to have been substituted with effect from the 1st day of January, 2016.

Explanatory Memorandum:-

With a view to implement the recommendations of the Seventh Pay Commission regarding the Central Government employees’ pension, the Central Government has decided to revise the pension of the Chairman, Vice-Chairmen and Members with effect from the 1st day of January, 2016 who were appointed before the 19th day of February, 2007. Accordingly, the Central Administrative Tribunal (Salaries and Allowances and Conditions of Service of Chairman, ViceChairmen and Members) Rules, 1985 are being amended with retrospective effect from the 1st day of January, 2016.
2. It is certified that no Chairman, Vice-Chairmen and Member of the Central Administrative Tribunal is likely to be affected adversely by the proposed amendment being given retrospective effect.

Note : Principle rules were published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i) vide notification number G.S.R. 644 (E) dated the 10th August, 1985 and subsequently amended vide notification numbers –
